ORDINANCE NO. 940134
Authorizing the expenditure of $20,849.00 in additional
funds to complete the water main relocation work in the area of Missouri
Highway 152 and I-29.
WHEREAS, by passage of Ordinance No. 64839 on
November 22, 1989, the City Council authorized a Utility Agreement between
Kansas City, Missouri and the Missouri Highway & Transportation Department;
and
WHEREAS, said agreement provided for the relocation
of water facilities in conjunction with roadway improvements in the area of
Missouri Highway 152 and I-29; and
WHEREAS, City has previously paid $54,322.82 under
the authority of Ordinance No. 64839 and is responsible for all the cost of the
water facilities relocation work in this project; and
WHEREAS, the State's final audit of this project
indicates a total cost for water facilities relocation of $75,171.12 reflecting
an amount due from City of $20,848.30; NOW THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section 1. That the Director of Water and Pollution
Control is hereby authorized to expend the sum of $20,848.30 from funds
previously appropriated to Account No. 94-801-080-7701-T to satisfy the cost of
this relocation work and conclude Utility Agreement No. 5935.

I hereby certify that there is a balance, otherwise
unencumbered, to the credit of the appropriation to which the foregoing
expenditure is to be charged, and a cash balance, otherwise unencumbered, in
the treasury, to the credit of the fund from which payment is to be made, each
sufficient to meet the obligation hereby incurred.
