Approving the preliminary plat of
Soho Lofts Condominiums on an approximately 1.2 acre tract of land generally
located on the north side of W. 8th Street, between May Street and Central
Street. (SD 1265)
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
the preliminary plat of Soho Lofts condominiums for 112 residential condominium
units, 6 commercial condominium units, and 2 commercial parking condominiums
within the existing mixed use building on an approximately 1.2 acre tract of
land generally located on the north side of W. 8th Street, between May Street
and Central Street, and more specifically described as follows:
Lots 6, 7, 8, 26,
27, 28 and 29, Block 6, King's Resurvey of Blocks 5, 6, 7 and 8, Hubbard's Addition,
a subdivision in Kansas City, Jackson County, Missouri, together with the West
1/2 of that portion of the vacated alley which is adjacent to the east line of
said Lots 26, 27 and 28, and together with the East 1/2 of the vacated alley
which is adjacent to the west line of said Lot 8, as vacated by Ordinance No.
62706, also together with the South 1/2 of the vacated alley which is adjacent
to the north line of said Lots 6, 7 and 8, as vacated by Ordinance No. 030934,
also together with the West 1/2 of the vacated alley lying adjacent to the east
line of said Lots 28 and 29, as vacated by Ordinance No. 030934. containing
53,956 square feet or 1.239 acres, more or less.
is hereby
approved, subject to the following conditions:
1.
That the developer cause the area to be platted and processed in
accordance with Chapter 66, Code of Ordinances of the City of Kansas City,
Missouri, commonly known as the Subdivision Regulations.
2.
That the developer secure permits to repair sidewalks, curbs and gutters
as necessary along the development street frontage as required by the City
Development Departments Development Services group in accordance with Chapters
56 and 64, Code of Ordinances, prior to recording of the plat.
3.
That the developer submit covenants, conditions and restrictions to the
Law Department for approval for the maintenance of common areas.
4.
That the developer receive the approval of the Board of Zoning Adjustment
for any necessary variances, as well as, an auxiliary parking lot and lease
agreement, as needed.
5.
That the developer contribute $13,388.40 in lieu
of parkland dedication for 112 multi-family units in satisfaction of Section
66-128 of the Subdivision Regulations at a rate of $9,961.61, per acre.
A copy of the preliminary plat is
on file in the office of the City Clerk with this ordinance and is made a part
hereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
preliminary plat hereinabove, all public notices and hearings required by the
Subdivision Regulations have been given and had.
