ORDINANCE NO. 140887

 

Rezoning approximately 8.08 acres generally located at the southwest corner of N.E. 102nd Terrace and N. Oak Trafficway from District R-80 to District R-7.5. (13993-P-3 known as New Mark Crossing.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning and Development Code, is hereby amended by enacting a new section to be known as Section 88-20A0980, rezoning an area of approximately 8.08 acres generally located at the southwest corner of N.E. 102nd Terrace and N. Oak Trafficway from District R-80 (Residential, 80,000 sq. ft. per unit required) to District R-7.5 (Residential, 7,500 sq. ft. per unit required), said section to read as follows:

 

Section 88-20A0980. That an area legally described as:

 

A tract of land in the Northwest Quarter of Section 35, Township 52 North, Range 33 West, Kansas City, Clay County, Missouri, including part of Lot 1, Kimberly Park, a subdivision of land in said Kansas City as recorded July 24, 1959 as Document No. B-23609, in Book 10 at Page 19, said tract of land being bounded and described as follows: Commencing at the Northeast corner of said Northwest Quarter; thence South 00 degrees 19 minutes 17 seconds West, along the East line of said Northwest Quarter, 982.49 feet to the Northeast corner of the South One-Half of the South One-Half of the Northeast Quarter of said Northwest Quarter; thence North 89 degrees 27 minutes 02 seconds West, along the North line of the South One-Half of the South One-Half of the Northeast Quarter of said Northwest Quarter, 62.61 feet to a point of the Westerly Right-of-Way line of North Oak Trafficway, as established in the Report of Commissioners Case No. CV104-005978CC as Tract No. 106, and recorded December 8, 2004, as Document No. T08788, in Book 4847 at Page 81; said point being the Point of Beginning of the tract of land to be herein described: thence North 89 degrees 27 minutes 02 seconds West, 207.41 feet; thence South 32 degrees 59 minutes 31 seconds West, 34.44 feet; thence Southwesterly along a curve to the right being tangent to the last described course with a radius of 325.00 feet, a central angle of 14 degrees 59 minutes 36 seconds and an arc distance of 85.05 feet; thence South 42 degrees 00 minutes 53 seconds East, 127.52 feet; thence South 57 degrees 50 minutes 50 seconds West, 152.34 feet; thence South 75 degrees 31 minutes 19 seconds West, 153.03 feet; thence South 03 degrees 13 minutes 59 seconds East, 17.81 feet to a point on the North line of Romey Hills First Plat, a subdivision of land in said Kansas City, recorded August 7, 1978 as Document No. D-74118 in Book 1321 at Page 271; thence North 89 degrees 28 minutes 47 seconds West, along the North line of said Romey Hills First Plat, 771.69 feet to the Southeast corner of Tract A, Deerfield First Plat, a subdivision of land in said Kansas City, recorded July 26, 1988 as Document No. G-13980, in Book 23 at Page 88; thence North 00 degrees 36 minutes 56 seconds East, along the East line of said Tract A, 328.16 feet to the Southwest corner of Lot 8, said Kimberly Park; thence South 89 degrees 27 minutes 02 seconds East, along the South line of said Kimberly Park, 807.75 feet to the Southwest corner of aforesaid Lot 1, Kimberly Park; thence North 00 degrees 32 minutes 58 seconds East, along the West line of said Lot 1, 138.50 feet to the Northwest corner thereof, said point also being on the Southerly right of way line of 102nd Terrace as established by said Kimberly Park; thence South 89 degrees 27 minutes 02 seconds East, along said Southerly right of way line and along the Northerly line of said Lot 1, 84.79 feet; thence Easterly along said Southerly right of way line and said Northerly lot line, along a curve to the right being tangent to the last described course with a radius of 208.44 feet, a central angle of 33 degrees 23 minutes 00 seconds and an arc distance of 121.45 feet; thence South 56 degrees 04 minutes 02 seconds East, along said Southerly right of way line and said Northerly lot line, 101.71 feet; thence Easterly along said Southerly right of way line and said Northerly lot line, along a curve to the left being tangent to the last described course with a radius of 291.79 feet, a central angle of 30 degrees 21 minutes 45 seconds and an arc distance of 154.63 feet; thence Easterly along the aforesaid Westerly right of way line of North Oak Trafficway, along a curve to the right having a common tangent with the last described course with a radius of 16.40 feet, a central angle of 10 degrees 06 minutes 06 seconds and an arc distance of 2.89 feet to the Point of Beginning. Containing 351,827 square feet or 8.077 acres, more or less.

 

is hereby rezoned from District R-80 to District R-7.5, all as shown outlined on a map marked Section 88-20A0980, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and in accordance with Section 88-20 thereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
