Approving the preliminary plat of
Richlin Condominiums on a 1.08 acre tract of land generally located at the
northwest corner of 46th Street and Broadway (4500-4540 Broadway). (SD 1283)
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A.
That the preliminary plat of Richlin Condominiums on an approximately 1.08 acre
tract of land generally located at the northwest corner of 46th Street and
Broadway (4500-4540 Broadway), and more specifically described as follows:
All that part of Lot 1, HOME PLACE, and all that part of Lots 28, 29, 30,
31, 32, 33, 34, 35, 36, 37, and 38, Block 1, EDWIN & LOCKWOOD'S 1ST
ADDITION, both being subdivisions of land in Kansas City, Jackson County,
Missouri, being bounded and described as follows: Beginning at the
intersection of the South line of said Lot 1 and the West right of way line of
Broadway Street, as now established; thence North 8729'18" West, along
said South line, said South line also being the North right of way line of 46th
Street, as now established, 89.30 feet to the Southwest corner of said Lot 1;
thence North 0223'43" East, along the West line of said Lot 1, 89.30 feet
West of and parallel with said West right of way line, 225.00 feet to the
Northwest corner of said Lot 1, said corner also being a point on the South
line of said Lot 38; thence North 8729'18" West, along said South line,
7.20 feet; thence North 02'22'43" East, 96.5 feet West of and parallel
with said West right of way line, 76.53 feet to a point on the South line of
said Lot 35; thence North 8722'23" West, along said South line, 0.50
feet; thence North 02'22'43" East, 97.00 feet West of and parallel with
said West right of way line, 200.00 feet to a point on the North line of said
Lot 28; thence South 8722'23" East, along said North line, 97.00 feet to
a point on said West right of way line; thence South 0223'43" West, along
said West right of way line, 501.53 feet to the Point of Beginning. Containing
46,887 square feet or 1.08 Acres more or less.
is hereby approved, subject to
the following conditions:
1.
That the developer cause the area to be platted and processed in
accordance with Chapter 66, Code of Ordinances of the City of Kansas City,
Missouri, commonly known as the Subdivision Regulations.
2.
That the final plat provide for a cross access easement between the two
separate condominium ownerships and phases as shown on the preliminary plat.
3.
That the developer secure permits to repair sidewalks, curbs, and
gutters as necessary along all development street frontages in accordance with
Chapters 56 and 64, Code of Ordinances, or submit a letter from a Missouri
licensed civil engineer stating that the sidewalks, curbs, and gutters are in a
good state of repair and meet the requirements set forth in Chapters 56 and 64,
Code of Ordinances, as required by the City Development Department prior to
recording of the plat.
4.
That the developer submit covenants, conditions and restrictions to the
City Development Department for review by the Law Department for approval for
the maintenance of common elements and private open space tracts.
5.
That the developer receive approval from the Board of Zoning Adjustment
for any necessary variances.
6.
That the developer contribute $6,813.74 in
lieu of parkland dedication for 57 multi-family units in satisfaction of
Section 66-128 of the Subdivision Regulations at a rate of $9,961.61, per acre
(57 x 2 x .006 = 0.684 acres x $9,961.61= $6,813.74).
A copy of the preliminary plat is
on file in the office of the City Clerk with this ordinance and is made a part
hereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
preliminary plat hereinabove, all public notices and hearings required by the
Subdivision Regulations have been given and had.
