ORDINANCE NO. 160746, AS AMENDED

 

Approving the petition to establish the 46th & Wornall Community Improvement District #2; establishing the 46th & Wornall Community Improvement District #2 generally located on the south side of W. 46th Street between Broadway Boulevard on the west and Wornall Road on the east and extending to W. 46th Terrace on the east side of the block in Kansas City, Jackson County, Missouri; authorizing the City Manager to execute a cooperative agreement with the petitioner in connection with the 46th & Wornall Community Improvement District #2; requiring the annual submission of certain records; directing the City Clerk to report the creation of the District to the Missouri Department of Economic Development; and providing an effective date.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the petition to establish the 46th & Wornall Community Improvement District #2 (the “District”) as a political subdivision in accordance with Section 67.1401 through Section 67.1571, RSMo, otherwise known as the Missouri Community Improvement District Act (the “Act”), is hereby approved in its entirety.

 

Section 2. That the District is hereby established for the purposes set forth in the petition, that the District shall have all the powers and authority authorized by the petition, the Act, and by law, and shall continue to exist for a period of 20 (twenty) years unless a new petition is submitted and approved pursuant to the terms of the Act.

 

Section 3. That the City Manager is hereby authorized to execute, on behalf of the City, a cooperative agreement with Plaza Hotels, LLC, or such other entity as may be identified by the project’s developer, whereby such entity will voluntarily make commitments with respect to providing funding to assist senior citizens in making home repairs needed to eliminate housing code violations. The agreement is approved in substantial form as attached hereto.

 

Section 4. That the District shall annually submit its proposed budget, report and copies of written resolutions passed by the District’s Board to the City pursuant to Section 67.1471, RSMo.

 

Section 5. That upon the effective date of this ordinance, the City Clerk is hereby directed to report the creation of the District to the Missouri Department of Economic Development pursuant to Section 67.1421.6, RSMo, by sending copy of this ordinance to said agency.

 

 


 

Section 6. That this ordinance shall become effective at such time as Plaza Hotels, LLC, or such other entity as may be identified by the project’s developer, and the City Manager shall execute the cooperative agreement authorized herein, or ten days after the date of passage by the City Council, whichever shall last occur.
