ORDINANCE NO. 050640

 

Approving an amendment to a previously approved preliminary plan in District R-3 on approximately a 5.96 acre tract of land generally located on the east side of James A. Reed Road from the south side of 65th Street to an area on both sides of 66th Street. (6334-CUP-1)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in District R-3 (Low Apartments, Low Density) on approximately a 5.96 acre tract of land generally located on the east side of James A. Reed Road from the south side of 65th Street to an area on both sides of 66th Street, and more specifically described as follows:

 

All that part of Lot 49 and the North 209.68 feet of Lot 56 of East Swope Highlands, a subdivision in Kansas City, Jackson County, Missouri, situated in the Southeast Quarter of Section 6, Township 48, Range 32 and being more particularly described as follows: Commencing at the Southwest corner of said Southeast Quarter (found iron bar); thence North 020113 East along the West line of said Southeast Quarter a distance of 426.20 feet; thence South 872701 East a distance of 46.00 feet to the East right-of-way line of James A. Reed road as now being established and the point of beginning; thence North 020113 East, 46.00 feet East of and parallel with the West line of said Southeast Quarter and along said East right-of-way line for a distance of 869.65 feet to the North line of said Lot 49; thence South 872021 East along said North line a distance of 284.36 feet to the Northeast corner of said Lot 49 (found 5/8 iron bar); thence South 020201 West along the East line of said Lots 49 and 56 a distance of 869.10 feet to the Southeast corner of the North 209.68 feet of said Lot 56; thence North 872701 West along the South line of said North 209.68 feet a distance of 284.15 feet to the point of beginning. Containing 247,113.49 square feet or 5.6729 acres more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2. That the developer dedicate additional right of way for secondary arterial as required by the Department of Public Works so as to provide a minimum of 40 feet of right of way as measured from the centerline of James A. Reed Road.

 

3. That the developer improve 66th Street to local street standards as required by the Department of Public Works, including curbs, gutters, storm sewers, sidewalks, streetlights, existing roadway section transitions to meet vertical and horizontal alignment standards, and relocation of utilities.

 

4. That the developer improve 65th Street to local street standards as required by the Department of Public Works, including curbs, gutters, storm sewers, sidewalks on the south side, streetlights, existing roadway section transitions to meet vertical and horizontal alignment standards, and relocation of utilities.

 

5. That the developer provide adequate site distance for the 65th and 66th Street connections to James A. Reed Road as required by the Department of Public Works.

 

6. That the developer place access restrictions to prohibit direct access to James A. Reed Road from the adjacent lots of the development and that the restriction be placed on the final plat.

 

7. That the developer submit a macro/micro storm drainage study to the City Engineer's Office for approval for the entire development when the first plat is submitted, and that the developer construct any improvements as required by the City Engineer's Office.

 

8. That the developer submit plans for grading, siltation, and erosion control to the City Engineer's Office for approval and permitting prior to beginning any construction activities.

 

9. That the developer obtain the grading consents, and all grading, temporary construction and drainage/sewer easements from the abutting property owner prior to submitting any public improvements.

 

10. That the developer secure a site disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing, or grubbing activities, if the disturbed area exceeds one acre.

 

11. That the developer contribute $7,530.98 in lieu of parkland dedication for 42 units (42 units 3 .006 $9,961.61 (year 2005) = $7,530.98) in satisfaction of Section 66-128 of the Subdivision Regulations for Swope Park.

 

12. That the developer extend water mains as required by the Water Services Department.

 

13. That the developer extend sanitary sewers to ensure individual service is provided to all proposed lots and determine adequacy as required by the Department of Public Works.

 

14. That the developer provide a storm water conveyance system to serve all proposed lots within the development and determine adequacy as required by the Department of Public Works.

 

15. That the developer submit a final plan to the City Plan Commission for approval, including detailed information on landscaping, signage (including elevations), and building elevations.

 

16. That the developer submit a street tree planting plan as part of the final plat, secure the approval of the City Forester for street trees planted on right-of-way in front of residential lots (with a copy to be submitted to the City Development Department staff), and agree to plant in conformance with the plan approved by the City Forester. The plan shall include size, type, species, and placement of trees.

 

17. That the developer secure approval of the Street Naming Committee for all street names prior to submittal of the first final plat, and that the developer submit a copy of the approved street name plan as part of each final plat submittal to the Department of City Development.

 

18. That the developer shall subordinate to the City all private interest in the area of any right-of-way dedication as required by the Department of Public Works and that the developer shall be responsible for all costs associated with subordination activities.

 

19. That the developer secure permits to construct sidewalks, curb, gutter, storm sewers, and streetlights as necessary along all development street frontages, as required by the Department of Public Works, prior to recording the plat.

 

20. That the developer submit covenants, conditions and restrictions to the Law Department for approval for the maintenance of private open space and enter into a covenant agreement for the maintenance of any stormwater detention area tracts.

 

21. That the developer submit a certificate of survey to the Department of City Development for approval prior to the sale of individual units.

 

22. That the 3:1 depth to width ratio per Section 66-124 of the Subdivision Regulations be waived for Lots 19 and 20.

 

A copy of said amendment is on file in the office of the City Clerk with this ordinance, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
