SECOND COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 941129

Amending Chapter 2, Code of Ordinances, commonly referred to as "Administration", by enacting a new Section 2-83, Obtaining Professional Services, by prohibiting the hiring of any attorney, architect, engineer or other professional firm or person if that person represents or is serving as an expert witness for persons in litigation against the City.

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That Chapter 2, Code of Ordinances, commonly referred to as "Administration", is amended by enacting a new Section 2-83, entitled Obtaining Professional Services, to read as follows:

Section 2-83. Obtaining Professional Services

(a) Neither the City Manager, nor any department, board or commission of the City, shall contract for professional services with any attorney who, at the time of the issuance of the contract, either in an individual or firm capacity, represents any party in litigation against the City, exclusive of representation in Municipal Court and exclusive of those attorneys employed by a not-for-profit legal services corporation. Nothing set forth in this section shall be deemed to supersede the Rules of Professional Conduct for Attorneys.

(b) Neither the City Manager, nor any department, board or commission of the City, shall contract for professional services with any architect, engineer, or other professional, exclusive of medical doctors, who, at the time of the issuance of the contract, serves as an expert witness for any party in litigation against the City.
