COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 910250

 

Amending Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 65.010A2358, rezoning a city block bounded by Admiral Boulevard, Flora Avenue, 8th Street and The Paseo and also the southeast corner of Admiral Boulevard and Flora Avenue from District C-3a1 (Intermediate Business - Low Buildings) to District PD/C-3a1 (Planned District/Intermediate Business - Low Buildings), and approving a development plan for the same. (11006-PD-1)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance is hereby amended by enacting a new section to be known as Section 65.010A2358, rezoning a city block bounded by Admiral Boulevard, Flora Avenue, 8th Street and The Paseo and also the southeast corner of Admiral Boulevard and Flora Avenue from District C-3a1 (Intermediate Business - Low Buildings) to District PD/C-3a1 (Planned District/Intermediate Business - Low Buildings), said section to read as follows:

 

Section 65.010A2358. That an area legally described as:

 

TRACT ONE: All that part of Lots 47 and 48, "RANSON PLACE", a subdivision of land; all of Lots 1 and 2; all that part of Lots 3 through 7, both inclusive, "NEISWANGER'S SUBDIVISION OF PARTS OF LOTS 47, 48, 49, 55, 56, AND 57, RANSON PLACE", a subdivision of land, all in Kansas City, Jackson County, Missouri, all being more particularly described as follows: Beginning at the southeast corner of said Lot 2; thence North 8735'33" West, along the south line of said Lot 2 and the south line of said Lot 3, a distance of 149.75 feet; to the intersection of said south line with the east right of way line of The Paseo, as now established; thence North 208'19" East, along said east right of way line, a distance of 205.81 feet; thence continuing northeasterly along said east right of way line along a curve to the right, tangent to the last described course, having a radius of 50.00 feet, a central angle of 9014'50", an arc distance of 78.76 feet, to a point on the south right of way line of Admiral Boulevard, as now established; thence South 8736'51" East, along said south right of way line, a distance of 99.53 feet, to the intersection of said south right of way line with the west right of way line of Flora Avenue, as now established; thence South 208'19" West, along said west right of way line, a distance of 256.09 feet (plat = 256.00 feet), to the point of beginning. Containing 37,803 square feet or 0.87 of an acre, more or less.

 

TRACT TWO: All that part of Lots 56 and 57, "RANSON PLACE", a subdivision of land in Kansas City, Jackson County, Missouri, described as follows: Beginning at the point of intersection of the north right of way line of 8th Street, as now established, with the east right of way line of The Paseo, as now established; thence North 208'19" East, along said east right of way line, a distance of 173.02 feet (plat = 173.00 feet), to the intersection of said east right of way line with the south line of an existing 16.00 foot alley; thence South 8735'33" East, along said south line, a distance of 149.75 feet, to the intersection of said south line with the west right of way line of Flora Avenue, as now established; thence South 208'19" West, along said west right of way line, a distance of 173.05 feet (plat = 173.00 feet), to the intersection of said west right of way line with the aforesaid north right of way line of 8th Street; thence north 8734'45" West, along said north right of way line, a distance of 149.75 feet to the point of beginning. Containing 25,912 square feet or 0.60 of an acre, more or less.

 

TRACT THREE: All that part of Lots 5, 6, and 7, "ASKEW'S PARTITION OF PART OF LOTS 44, 45, 46, 47, 57, 58, 59, AND 60, RANSON PLACE", a subdivision of land, all in Kansas City, Jackson County, Missouri, described as follows: Beginning at the intersection of the south right of way line of Admiral Boulevard with the east right of way line of Flora Avenue, as said boulevard and avenue are now established; thence South 8736'51" East, along said south right of way line, a distance of 90.00 feet; thence South 208'19" West, parallel with the said east right of way line of Flora Avenue, a distance of 269.13 feet (plat = 269.00 feet), to the south line of said Lot 5; thence North 8734'29" West, along last said south line, a distance of 90.00 feet to the intersection of last said south line with the aforesaid east right of way line of Flora Avenue; thence North 208'19" East along said east right of way line, a distance of 269.07 feet (plat = 269.00 feet), to the point of beginning. Containing 24,219 square feet or 0.56 of an acre, more or less.

 

is hereby rezoned from District C-3a1 (Intermediate Business - Low Buildings) to District PD/C-3a1 (Planned District/Intermediate Business - Low Buildings), all as shown outlined on a map marked Section 65.010A2358, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 65.010 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer submit a storm drainage study as required.

 

2. That the developer cause the area to be platted and processed in accordance with Chapter 31, Code of General

Ordinances of Kansas City, Missouri, commonly known as

the Subdivision Regulations.

 

3. That the developer remove all old entrances onto the subject properties.

 

4. That the developer remove the 18 inch stone wall on the east lot.

 

5. That the developer petition for the vacation of the alley on the west lot.

 

6. That the developer provide additional fire protection in accordance with the Fire Department requirements.

 

 

That a copy of the development plan is on file in the Office of the City Clerk under Document No. 910250 which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had. ____________________________________________________________

 

I hereby certify that as required by Chapter 39, Code of General Ordinances, the foregoing ordinance was duly advertised and public hearings were held.
