ORDINANCE NO. 970451

 

Amending Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 80-11A0047, rezoning an area of approximately 1.8 acres generally located at 7700 Blue Parkway from District R-1a (One-Family Dwellings) to District M-1-p (Light Industry - Limited District), and approving a preliminary plan for the same. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0047, rezoning an area of approximately 1.8 acres generally located at 7700 Blue Parkway from District R-1a (One-Family Dwellings) to District M-1-p (Light Industry - Limited District), said section to read as follows:

 

Section 80-11A0047. That an area legally described as:

 

That part of Lots 6 and the west 60 feet of Lot 7 lying northwesterly of the centerline of a branch running through said lots and northeasterly of the northeasterly line of the right of way of Highway 50. Also that part of the east 293 feet of Lot 7, lying northerly of a line commencing at a point in the east line of said Lot 7, 53 feet south of the northeast corner of said lot; thence southwesterly along a line making a southwest angle of 62 41' with the east line of said lot, a distance of 185.47 feet; thence along a line deflecting 21 13' to the left, a distance of 133.05 feet, more or less, to a point 60 feet east of the west line of said lot, measured at right angles thereto, all in Sherrard Heights, a subdivision in Kansas City, Jackson County, Missouri, the perimeter lines of the foregoing being generally described as follows: Beginning at the northeast corner of said Lot 7; thence south along the east line of said lot, 53 feet; thence southwest along a line making a southwest angle of 62 41', with the east line of said lot, a distance of 185.47 feet; thence south along a line deflecting 21 13' to the left, a distance of 133.05 feet, more or less, to a point 60 feet east of the west line of said Lot 7, measured at right angles thereto, said point being in the center branch running through said Lot; thence continuing southwesterly along the centerline of said branch 54.5 feet, more or less, to the northeasterly line of the right of way for Highway Route 50, thence northwesterly along said right of way line 369 feet, more or less to the point of intersection of said line with the north line of Lot 6, thence east along the north line of said Lots 6 and 7, 434.5 feet, more or less, to the point of beginning, in said Sherrard Heights. Contains 78,591 square feet, 1.8 acres, more or less.

 

is hereby rezoned from District R-1a (One-Family Dwellings) to District M-1-p (Light Industry - Limited District), all as shown outlined on a map marked Section 80-11A0047, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a preliminary plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer submit a storm drainage study for the entire development to the City Engineer's Office for approval and that the developer make any necessary

improvements as required by the City Engineer's Office.

 

2. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

3. That the developer remove the existing fence located in the right of way and replace it along the front property line.

 

A copy of said preliminary plan is on file in the office of the City Clerk under Document No. 970451, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
