ORDINANCE NO. 960478

 

Vacating a portion of N.W. 86th Terrace cul-de-sac west of N. Amity Avenue and adjoining Lots 119 and 120 "Wildwood", and all utility easements over, under, along and across said street, in Kansas City, Platte County, Missouri.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. The Council of Kansas City does hereby find and declare that on the 12th day of December, 1995, a petition was filed with the City Clerk of Kansas City by Five Star Homes, Inc., for the vacation of a portion of N.W. 86th Terrace cul-de-sac described as follows: Beginning at the northeast corner of Lot 119 "Wildwood" thence South 40 10'29" West, along the north line of said lot, 105.25 feet (meas.) (Plat-103 feet) to a point of curvature; thence along a curve to the right in a southwesterly, northwesterly, and northeasterly direction, having a radius of 7 feet, a chord bearing of North 33 06'10" West, an arc distance of 278.93 feet to a point on a curve; thence along said curve to the right in a southwesterly direction, having a radius of 15 feet, a chord bearing of South 71 33'37" West, an arc distance of .42 feet to a point of reverse curvature; thence along said reverse curve to the left in a southwesterly, southeasterly, and northeasterly direction, having a radius of 50 feet, a chord bearing of South 50 54'51" East, an arc distance of 215.17 feet to a point of reverse curvature; thence along said reverse curve to the right in a northeasterly direction, having a radius of 15 feet, a chord bearing of North 48 16'57" East, an arc distance of 22.24 feet; thence South 89 14'11" East, 67.08 feet to the point of beginning, and all utility easements over, under, along and across said cul-de-sac all in Section 11-51-34, in Kansas City, Platte County, Missouri, giving the distinct description of the street to be vacated, and also the names of the persons and corporations owning or claiming to own the property fronting thereon, and that due notice of the pendency of said petition has been given for twenty (20) days in the newspaper doing the city printing, and that the consent of the persons and corporations owning or claiming to own three-fourths of the front feet of the property immediately adjoining said street has been obtained in writing, that said consent has been acknowledged as deeds are acknowledged, and was duly filed with the petition for such vacation in the City Clerk's Office.

 

Section 2. That the Council finds that the City Plan Commission has duly endorsed its approval of this Ordinance hereon.

 

Section 3. That a portion of N.W. 86th Terrace cul-de-sac described as follows: Beginning at the northeast corner of Lot 119 "Wildwood" thence South 40 10'29" West, along the north line of said lot, 105.25 feet (meas.) Section 4. That the City Clerk of Kansas City, Missouri, be and she is hereby authorized and directed to acknowledge this ordinance as deeds are acknowledged, and to cause this ordinance and the consent of property owners hereinbefore referred to, to be filed for record in the Recorder's Office in Platte County, Missouri.

 

Section 5. All Ordinances or parts of Ordinances in conflict with this Ordinance are, in so much as they conflict with this Ordinance, hereby repealed.
