ORDINANCE NO. 110485

 

Authorizing the Director of Public Works to enter into an agreement with the 3-Trails Village Community Improvement District for the design of a segment of Bannister Trail.

 

WHEREAS, City has appropriated $100,000.00 within the 2010-2011 Capital Improvements Program to supplement 3-Trails Village Community Improvement District, (“CID”) funds for design work; and

 

WHEREAS, CID received a federal grant in the amount of $30,000.00 from National Parks Services for the purpose of developing trail sites along Santa Fe Trail in Jackson County; and

 

WHEREAS, the 3-Trails Village is a primary trail corridor of the Kansas City, Missouri Citywide Trails Plan and is part of the Metro Green trails plan of Mid-America Regional Council and the south Kansas City Sixth District Pedestrian Intermodal Transportation Corridor plan; and

 

WHEREAS, CID has agreed to contribute any additional funds required for the design of this segment from its budget; and

 

WHEREAS, CID will, following the receipt of City’s contribution, execute a design contract with a design professional firm for purpose of preparation of final construction plans; and

 

WHEREAS, City and CID mutually agree that it is in their collective best interests to work cooperatively on this project; NOW THEREFORE;

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of Public Works is authorized to enter into a cooperative agreement with the 3-Trails Village Community Improvement District related to the design of the Bannister Trail segment A-F from Elmwood to Marion Park Drive. A copy of this agreement, in substantial form, is on file in the office of the Director of Public Works.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
