ORDINANCE NO. 910439

 

Accepting two Special Warranty Deeds and a Quit Claim Deed from the Kansas City, Missouri School District conveying to the City six tracts of land generally located near 34th and Linwood and 31st and Indiana for public use for the expansion of Central Park, accepting and approving a Cooperative Agreement for Maintenance and Use of Central Park Public Improvements between the City and the School District providing for improvements to and maintenance of Central Park and its use by the School District, and placing two adjoining City-owned tracts of property under the jurisdiction of the Board of Parks and Recreation Commissioners as additions to Central Park.

WHEREAS, the Council finds and determines that by Resolution No. 21443 adopted by the Board of Parks and Recreation Commissioners on March 19, 1991, certain lands were acquired for public use for park purposes in Kansas City, Jackson County, Missouri, and said Board has now recommended to the Council that such deeds hereinafter be accepted for such public use; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That two (2) Special Warranty Deeds and a Quit Claim Deed conveying from the School District of Kansas City, Missouri to the City of Kansas City, Missouri six tracts of land generally located near 34th and Linwood Boulevard and 31st and Indiana in Kansas City, Jackson County, Missouri, are hereby accepted for public use for the expansion of Central Park. Said tracts of land are more specifically described in Exhibit "A" which is attached hereto and made a part hereof by reference.

 

Section 2. That upon the effective date of this Ordinance, the City Clerk is hereby directed to cause this Ordinance and the herein described deeds to be recorded in the Office of the Director of Records for Jackson County, Missouri, as evidence of the acceptance of said land by the City for public use for park purposes. The Council further declares that in accordance with the provisions of Resolution No. 21443 adopted March 19, 1991, by the Board of Parks and Recreation Commissioners, said lands shall, as provided by Article III, Section 58 of the Charter of Kansas City, Missouri, remain as part of the parks system of Kansas City forever.

 

Section 3. That a Cooperative Agreement for Construction, Maintenance and Use of Central Park Public Improvements between the School District of Kansas City, Missouri and the City of Kansas City, Missouri providing for the construction of improvements to and maintenance of Central Park and for its continued use by the School District is hereby accepted and approved. A copy of said agreement is attached hereto and made a part hereof by reference, and the City Clerk is hereby directed to file a copy of said agreement in the Office of the Secretary of State of Missouri and in the Office of Director of Records for Jackson County, Missouri.

 

Section 4. That the Council further declares that in accordance with the provisions of the previously referred to Resolution No. 21443 of the Board of Parks and Recreation Commissioners, two additional tracts of land which are described in Exhibit "B", which is attached hereto and made a part hereof by reference, that are City-owned property previously used by the Fire Department, are hereby transferred to the jurisdiction of the Board of Parks and Recreation Commissioners as and for additions to Central Park, and said lands shall, as provided by Article II, Section 58 of the Charter of Kansas City, Missouri, also remain as part of the parks system of Kansas City forever. ___________________________________________________
