ORDINANCE NO. 920463

 

Amending Chapter 34, Code of General Ordinances of Kansas City, Missouri, commonly referred to as the Traffic Code, by enacting Section 34.318.1 prohibiting vision-reducing material applied to windshields and Section 34.259 increasing the penalty for violations of Article XVII of the Traffic Code, which regulates the size, weight, and load of vehicles.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Chapter 34, Code of General Ordinances of Kansas City, Missouri, commonly referred to as the Traffic Code, is hereby amended by enacting Section 34.318.1 and Section 34.259 to read as follows:

 

Section 34.318.1. Vision-Reducing Material applied to windshield.

 

(a) No person shall operate any motor vehicle registered in this state on any public highway or street of this city with any manufactured vision-reducing material applied to any portion of the motor vehicle's windshield, sidewings, or windows located immediately to the left and right of the driver which reduces visibility from within or without the motor vehicle.

 

(b) This section shall not prohibit labels, stickers, decalcomania, or informational signs on motor vehicles or the application of tinted or solar screening material to recreational vehicles as defined in Section 700.010, RSMo., provided that such material does not interfere with a driver's normal view of the road. This section shall not prohibit factory installed tinted glass, the equivalent replacement thereof or tinting material applied to the upper portion of the motor vehicle's windshield which is normally tinted by the manufacturer of motor vehicle safety glass.

 

(c) This ordinance shall not apply to any person who has procured a permit from the Missouri Department of Public Safety to operate a motor vehicle with a front sidewing vent or window that has a sun screening device. This permit allows operation of the vehicle by immediate family members who are husband, wife and sons or daughters who reside in the household.

 

Section 34.259. Penalty.

 

Every person who is convicted under the provisions of this Article, excepting Sections 34.243 and 34.257, shall be punished by imprisonment in the place designated by law for not less thirty (30) days nor more than six (6) months, or by a fine not less than one hundred dollars ($100.00) nor more than five hundred dollars ($500.00) or by both such fine and imprisonment. Any person convicted under Sections 34.243 or 34.257 shall be penalized as set forth in Section 34.350.
