COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 061399

 

Approving a preliminary development plan in District GPA on approximately a 10.74 acre tract of land generally located approximately one-quarter mile north of County Line Road (E. 155th Street) between Peterson Road and Horridge Road. (13652-GP)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a preliminary plan approved in District GPA (General Planned District, Agricultural) on approximately a 10.74 acre tract of land generally located approximately one-quarter mile north of county Line Road (E. 155th Street) between Peterson Road and Horridge Road, and more specifically described as follows:

 

All that part of the Southeast quarter of Section 33, Township 47, Range 32, in Kansas City, Jackson County, Missouri, more particularly described as follows: Beginning at the Southeast corner of the Southeast quarter of said Section 33; thence North 87 degrees 31 minutes 40 seconds West along the South line of the Southeast quarter of said Section 33 a distance of 120.00 feet; thence North 02 degrees 23 minutes 20 seconds East a distance of 1086.58 feet; thence North 87 degrees 36 minutes 39 seconds West a distance of 483.45 feet; thence North 00 degrees 00 minutes 00 seconds East a distance of 521.00 feet; thence North 87 degrees 13 minutes 11 seconds East a distance of 627.72 feet to a point on the East line of the Southeast quarter of said Section 33; thence South 02 degrees 23 minutes 20 seconds West along the East line of the Southeast quarter of said Section 33 a distance of 1663.86 feet to the Point of Beginning. Containing 10.74 acres.

 

is hereby approved, subject to the following conditions:

 

1.                  That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2.                  That the developer submit a detailed micro storm drainage study, consisting at a minimum of a letter from a Missouri licensed civil engineer stating that the proposed improvements will not alter or increase historical runoff conditions for the site, to Development Services prior to review and issuance of any building permits, and that the developer construct any improvements as required by Development Services.

 

3.                  That the developer dedicate additional right of way for a primary arterial as required by Development Services so as to provide a minimum of 50 feet of right of way as measured from the centerline of County Line Road (E. 155th Street).


4.                  That the developer subordinate to the City all private interest in the area of any right-of-way dedication as required by Development Services, and that the developer be responsible for all costs associated with subordination activities.

 

5.                  That the developer submit plans for grading, siltation, and erosion control to Development Services for approval and permitting prior to beginning any construction activities.

 

6.                  That the developer secure a land disturbance permit from Development Services prior to beginning any construction, grading, clearing, or grubbing activities, if the disturbed area exceeds one acre.

 

7.                  That the extension of the public sanitary sewer system be waived, provided that the developer demonstrates that the existing private sewage disposal system complies with Chapter 18, Kansas City Building and Rehabilitation Code, Code of Ordinances, at the time of each application for building permits, which may add plumbing fixtures.

 

8.                  That the developer submit a final plan to the City Plan Commission for approval including grading, fencing, landscaping and substation elevations.

 

9. That the driveway be hard surfaced from County Line Road to the proposed gate as shown on the development plan.

 

A copy of said amendment is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
