Approving a development plan in
District R-5 on approximately a 0.2 acre tract of land generally located on the
west side of Warwick Boulevard between E. 43rd Street to the north and E. 44th
Street to the south, to allow two principal structures on one lot with
deviations to the lot and building standards of this zoning district, to allow
for two principal buildings to remain on a single lot. (14741-P-1)
BE IT ORDAINED BY THE
COUNCIL OF KANSAS CITY:
Section A. That a development
plan in District R-5 (Residential 5) on approximately a 0.2 acre tract of land
generally located on the west side of Warwick Boulevard between E. 43rd Street
to the north and E. 44th Street to the south, and more specifically described
as follows:
Lot 4 and the north
5 feet of Lot 5, South Hyde Park, a subdivision in Kansas City, Jackson County,
Missouri, and all of the 6-foot vacated alley west of and adjoining said Lot 4
and the north 5 feet of Lot 5; also the east 20.48 feet of the north 40 feet of
Lot 46, the West Estate Subdivision, a subdivision in Kansas City, Jackson
County, Missouri; also a tract of land 8 feet, more or less, in width east of
and adjoining the north 40 feet of said lot 46 between the north line of said
lot, and a line 40 feet south of and parallel to the said north line, extended
from the east line of said lot to the west line of South Hyde Park, in Kansas
City, Jackson County, Missouri according to the respective plats.
is hereby approved, subject to
the following conditions:
1.
The applicant shall obtain necessary change of use classification
and certificate of occupancy as required for all structures.
2.
The developer shall apply and obtain building permits for all work
done without permit.
3.
The developer shall coordinate with Historic
Preservation/Landmarks Division to determine if a certificate of
appropriateness is necessary as this property is on the Kansas City Register of
Historic Places.
4.
The developer shall coordinate with the Parks and Recreation
Department regarding a parkland fee as this property is located off Warwick
Boulevard under jurisdiction of the Parks and Recreation Department.
A copy of said development plan
is on file in the office of the City Clerk with this ordinance and is made a
part hereof.
Section B. That the
Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices and hearings required by the Zoning
Ordinance have been given and had.
