COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 041381

 

Amending Ordinance No. 951024 by repealing its Section 2 and enacting in its place a new Section 2, correcting the legal description of Project 8 of the Summit Tax Increment Financing Plan as a Redevelopment Project, and affirming the prior adoption of tax increment financing therein.

WHEREAS, the City Council of Kansas City, Missouri (City Council), by Ordinance No. 54556, passed on November 24, 1982, and thereafter amended in certain respects by Ordinance No. 911076, passed on August 29, 1991, created the Tax Increment Financing Commission of Kansas City, Missouri (the Commission); and

WHEREAS, on August 31, 1995, the City Council adopted Committee Substitute for Ordinance No. 951016, approved the Summit Tax Increment Financing Plan, found the Redevelopment Area to be a conservation area, and designated the Redevelopment Area as a redevelopment area pursuant to the Real Property Tax Increment Allocation Redevelopment Act, R.S.Mo. 99.800 et seq. (the Act); and

WHEREAS, on August 10, 2000, the City Council passed Committee Substitute for Ordinance No. 951024, which approved Project 8 of the Summit Tax Increment Financing Plan as a Redevelopment Project and adopted tax increment financing therein; and

WHEREAS, the Project 8 legal description set forth in Section 2 of Committee Substitute for Ordinance No. 951024 contained a scriveners error; and

WHEREAS, when enacting Committee Substitute for Ordinance No. 951024, it was the City Councils intent that Project 8 be comprised of the property legally described herein; and

WHEREAS, it is necessary to correct the Committee Substitute for Ordinance No. 951024 Section 2 Project 8 legal description in order to properly implement tax increment financing thereon as intended by Committee Substitute for Ordinance No. 951024; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That Committee Substitute for Ordinance No. 951024 is hereby amended by repealing Section 2 of that ordinance and enacting in its place a new section 2, to read as follows:

Section 2. The area selected for Project 8, legally described as follows:

Pershing Building Improvements

A tract of land being Lots 1, 2, 3 and 4, WALDO TRACT, and Lots 13 and 14, except the parts of said Lots taken for Wyandotte Street, and all that part of Lot 15 Lying Southerly of Pershing Road and West of Wyandotte Street, as said road and street are now established, in WALDO PLACE, and the North 5 feet of Lot 51 and all of Lot 52 in WALNUT RIDGE, all being subdivisions in Kansas City, Jackson County, Missouri, according to the recorded plats thereof, being more particularly described as follows:

Beginning at the Southeast corner of said Lot 1, WALDO TRACT; thence N 89 31' W along the South line of said Lots 1, 2, 3 and 4, WALDO TRACT a distance of 1 foot, thence S 00 29' W a distance of 7.5 feet; thence N 89 31' W a distance of 101.3 feet; thence N 00 29' E along the West line of said Lot 4 and the Southerly prolongation a distance of 127.4 feet to the Northwest corner of said Lot 4 said point also being the South right-of-way line of Pershing Road; thence S 89 31' E along said South right-of-way line a distance of 176.2 feet; thence N 70 18' E continuing along said South right-of-way line a distance of 44.5 feet to a point on the West right-of-way line of Wyandotte Street; thence S 00 29' W along said West right-of-way line a distance of 100.3 feet; thence N 89 31' W a distance of 115.7 feet to a point on the East line of said Lot 1, WALDO TRACT; thence S 00 29' W along said East line a distance of 35.0 feet to the point of beginning.

Surface Parking Lot:

Tract of land being part of Lots 43 through 51 WALNUT RIDGE, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof, being more particularly described as follows:

Beginning at a point 15 feet North of the Southwest corner of said Lot 51, WALNUT RIDGE; thence N 89 31' E a distance of 115.7 feet; thence S 00 29' W a distance of 13.6 feet; thence S 32 52' W a distance of 214.9 feet to the intersection of the East line of WALDO TRACT and the West line of the land condemned by Kansas City, Missouri, for park purposes by Ordinance No. 52958, approved July 29, 1926; thence N 00 29' E a distance of 195.2 feet to the point of beginning.

is approved and designated as Project 8 of the Summit Tax Increment Financing Plan, as amended, and tax increment allocation financing is adopted therein, effective August 10, 2000 (the Original Effective Date). The actions of all City officials and the Tax Increment Financing Commission of Kansas City, Missouri, in allocating, paying, depositing, receiving and/or disbursing payments in lieu of taxes or economic activity taxes for areas within the area described by this ordinance, which have been approved after the Original Effective Date , but prior to the effective date of this ordinance , are


hereby ratified and approved. As and from the Original Effective Date, the Project 8 propertys certified total initial equalized assessed value is the Project 8 propertys assessed value in the year 2000, and payments in lieu of taxes generated therefrom shall be allocated, collected and paid to the Summit Special Allocation Fund as described in the TIF Act and Section 3 of this ordinance.
