RESOLUTION NO. 121044

Consenting to the transfer of vacant property located at 6640 Eastwood Trafficway [Jackson County Tax Parcel No. 31-710-08-13-01-0-00-000] by Land Trust of Jackson County, Missouri to the City of Kansas City, Missouri for the purpose of the expansion of an existing facility used by the Fire Department of the City.

WHEREAS, the City owns the property located at 6750 Eastwood Trafficway [Jackson County Tax Parcel No. 31-710-08-02-01-0-00-000], upon which is located a facility used for operations of the Fire Department; and

 

WHEREAS, the City desires to expand the existing facility to better serve the residents of the City; and

 

WHEREAS, the expansion will displace existing parking, which is in need of replacement; and

 

WHEREAS, the Land Trust holds title to an abutting track of property commonly referred to as 6640 Eastwood Trafficway [Jackson County Tax Parcel No. 31-710-08-13-01-0-00-000] (“Transfer Parcel”) and has held such title since the recording of the Court Administrator’s Deed recorded December 7, 2006; and

 

WHEREAS, pursuant to Section 141.760.2 of the Missouri Statutes, the Land Trust has the authority, upon the recommendation of the Land Commissioner, to classify certain properties in their inventory as suitable for a public use, and the Land Commissioner has recommended that the Transfer Parcel be so classified as suitable for public use, at the request of the City; and

 

WHEREAS, pursuant to Section 141.760.2 of the Missouri Statutes, the Land Trust may at their sole discretion set the terms and price of a parcel classified as suitable for a public use; NOW, THEREFORE,

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the City of Kansas City, Missouri (“City”) hereby authorizes its appointed land trustee and all other appointed land trustees that serve now or in the future on the Land Trust of Jackson County, Missouri (“Land Trust”) to vote for the approval of the transfer for a public purpose of 6640 Eastwood Trafficway [Jackson County Tax Parcel No. 31-710-08-13-01-0-00-000] (“Transfer Parcel”) to the City so as to be in conformity with the statutory requirements of Sections 141.760.2 of the Missouri Statutes.

Section 2. That the Mayor and Council urge the other taxing jurisdictions in Kansas City, Missouri, holding any interest in the Transfer Parcel held by Land Trust to relinquish the same in the public interest and to support the transfer to the City of the Land Trust’s interest in the Transfer Parcel for the public purpose of use by the City’s Fire Department, including related parking, on the Transfer Parcel for the purpose of expanding the existing facility utilized by the Fire Department on the abutting property located at 6750 Eastwood Trafficway [Jackson County Tax Parcel No. 31-710-08-02-01-0-00-000].

Section 3. That the City hereby authorizes the Land Trust to attach to any deed to property the transfer of which is pursuant to this Resolution, a duly certified copy of this Resolution as evidence of the City’s public purpose for the Transfer Parcel, as required by RSMo. 141.760.2. The Land Trust may rely upon this Resolution until written notice is given of its revocation and withdrawal.
