COMMITTEE SUBSTITUTE FOR RESOLUTION NO. 041128

 

Approving the tenth amendment to the Oak Park North Area Plan by amending the Proposed Land Use Plan and Map for an area of approximately 8.4 acres generally bounded by 38th Street on the north 39th Street on the south, Elmwood Avenue on the east and Kensington Avenue on the west, to recommend low density residential, retail commercial, and high density residential uses instead of medium density residential uses and mixed use (public/semi-public and residential).

 

WHEREAS, the Oak Park North Area Plan was approved by the City Council by Resolution No. 47190, adopted December 16, 1976, as a guide for future development and redevelopment of the area generally bounded by Troost Avenue, Stadium Drive and Leeds Trafficway, 31st Street and 39th Street; and

 

WHEREAS, the Oak Park North Area Plan was amended on April 13, 1989, by Resolution No. 63760; was amended on February 13, 1997, by Resolution No. 970096; was amended on June 17, 1999, by Resolution No. 990674; was amended on September 27, 2001, by Resolution No. 011206; was amended on June 6, 2002, by Resolution No. 020562; was amended on August 15, 2002, by Resolution No. 020911, was amended on December 5, 2002, by Resolution No. 021355; and was amended by Resolution No. 031335 on January 8, 2004, and was further amended by Resolution No. 040330 on April 15, 2004; and

 

WHEREAS, after further review by the City Development Department it has been deemed appropriate to amend the Oak Park North Area Plan as it affects that area generally bounded by 38th Street on the north, 39th Street on the south, Elmwood Avenue on the east and Kensington Avenue on the west, by modifying the recommended land uses to recommend low density residential, retail commercial and high density residential uses instead of medium density residential uses and mixed use (public/semi-public and residential); and

 

WHEREAS, public notice of a hearing before the City Plan Commission was published on October 18, 2004; and

 

WHEREAS, the City Plan Commission considered such amendment to the Proposed Land Use Plan and Map on December 21, 2004; and

 

WHEREAS, after all interested persons were given an opportunity to present testimony, the City Plan Commission did on December 21, 2004, recommend approval of the proposed amendment to the Oak Park North Area Plan which designates the recommended uses as those existing prior to the adoption of Resolution No. 040330; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the tenth amendment to the Oak Park North Area Plan is hereby approved as to the Proposed Land Use Plan and Map for that area generally bounded by 38th Street on the north, 39th Street on the south, Elmwood Avenue on the east and Kensington Avenue on the west, by modifying the recommended land uses to recommend low density residential, retail commercial and high density residential uses instead of medium density residential uses and mixed use (public/semi-public and residential). A copy of the tenth amendment to the Land Use Plan and Map of the Oak Park North Area Plan is attached hereto as Exhibit A and incorporated herein by reference.

 

Section B. That the amendment to the Oak Park North Area Plan is consistent and complies with the FOCUS Kansas City Plan, adopted on October 30, 1997, by Committee Substitute for Resolution No. 971268, and is adopted as a supplement to the FOCUS Kansas City Plan.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices have been given and hearings have been held as required by the law.
