ORDINANCE NO. 070099
Authorizing the City Manager to
permit the Performing Arts Community Improvement District to waive certain
solicitation requirements associated with excavation work for the South Parking
Garage and to solicit the architectural and engineering design services and the
construction of the South Parking garage on a design-build basis.
WHEREAS, on May 19,
2005 the City Council passed Ordinance No. 050608 in which it expressed its
intent for the City to identify funding for the construction of a public
parking garage adjacent to, and to the south of, the Performing Arts Center;
and
WHEREAS, this public
parking structure has become to be commonly referred to as the South Parking
Garage; and
WHEREAS, because the
excavation of the site on which the Performing Arts Center is to be situated
has begun and because the excavation of the adjacent site for the South Parking
Garage at the same time presents opportunities for cost savings and design and
construction coordination: and
WHEREAS, on November
30, 2006, the City Council passed Ordinance No 061298 approving the execution
of a Cooperative Agreement with the Performing Arts Community Improvement
District related to the funding of excavation and design work in connection
with the construction of the South Parking Garage; NOW, THEREFORE,
BE IT ORDAINED BY THE
COUNCIL OF KANSAS CITY:
Section 1. That the
City Manager is hereby authorized to allow the Performing Arts Community
Improvement District to waive solicitation requirements relating to the mass
excavation work related to the eventual construction of the South Parking
Garage if, he deems it to be in the Citys best interest.
Section 2. That
the City Manager is hereby authorized to allow the Performing Arts Community
Improvement District to solicit the architectural and engineering design
services and the construction work for the South Parking Garage on a
design-build basis, if he deems it to be in the Citys best interest.
