COMMITTEE SUBSTITUTE
FOR ORDINANCE NO. 050921
Approving the 2005 Community
Development Action Plan contracts and authorizing the City Development
Department to execute contracts totaling $3,482,500.00 for agencies responsible
for implementing the Action Plan for Community Development Services.
WHEREAS, Congress and
the President signed the Cranston-Gonzalez National Affordable Act on November
28, 1990; and
WHEREAS, Title I of the
National Affordable Housing Act of 1990, as amended (Title I) requires cities
to submit to the United States Department of Housing and Urban Development
(HUD) a document which consolidates four entitlement programs into a 5-year Consolidated
Plan; and
WHEREAS, Title I
requires cities to submit a 5-year Consolidated Plan inclusive of a 1-year
Action Plan, and any amendments to the 5-year Plan on an annual basis; and
WHEREAS, Title I
authorizes the Secretary of the HUD to award grants to units of local
government, such as the City of Kansas City, Missouri (City), to finance its
Community Development and Housing Programs; and
WHEREAS, the
four grant programs included within the 2005 Consolidated Action Plan are the
Community Development Block Grant Program (CDBG), the HOME Investment
Partnership Act Program, the Emergency Shelter Grant Program, and the Housing
Opportunities for Persons with Aids Program; and
WHEREAS,
for 2005, the City submitted a 1-year action plan showing housing and community
development activities, performance goals and funding amounts from each grant
source applicable to the four grant programs pursuant to and in accordance with
Title I; and
WHEREAS,
the 2005 1-year Action Plan includes housing and community development
strategies for the 5-year period, which were developed from the following
sources: the Housing Task Force recommendations, the adopted City Housing
Policy Goals, the 2000 Census, and the completed Housing Conditions Survey
with designated targeted areas; and
WHEREAS,
the local HUD office approved the 2005 Action Plan on June 28, 2005; and
WHEREAS,
on April 7, 2005 through Resolution No. 050253, as amended, the Council
approved the following agencies and the recommended amounts:

BY THE COUNCIL OF KANSAS CITY:
Section 1. That the
2005 One-Year Consolidated Action Plan is hereby amended by the following
changes to CDBG allocations:

Section 2. That the Director of the City Development, on
behalf of the City, is hereby authorized to enter into and execute contracts
with the above listed agencies from funds previously appropriated to the
following accounts in the General Fund, No. 1000 and Community Development
Block Grant Fund, No. 2660:

Section 3. That the
City Council hereby directs the City Manager to recover all unrestricted City
program income from its funded outside agencies for use in fulfilling the
objectives of the 2005 Consolidated Action Plan.
Section 4. That the
City Council further directs the City Manager to develop an interim financing
plan that will allow the City to fulfill the objectives of the 2005
Consolidated Action Plan without significant reductions to the consolidated
plan budget as approved.

I hereby certify
that there is a balance, otherwise unencumbered, to the credit of the
appropriation to which the foregoing expenditure is to be charged, and a cash
balance, otherwise unencumbered, in the treasury the credit of the fund from
which payment is to be made, each sufficient to meet the obligation hereby
incurred.
