ORDINANCE NO. 160234

 

Estimating revenue in the amount of $1,050,000.00 in the Capital Improvements Fund; appropriating $1,600,000.00 in the Capital Improvements Fund for repairs to the Bartle Hall Sky Station; authorizing a contract with A. Zahner Company in the amount of $1,300,000.00, and recognizing this ordinance as having an accelerated effective date.

 

WHEREAS, during routine inspections of the Sky Stations on top of the pylons at the Kansas City Convention Center (Bartle Hall), it was discovered that damage had occurred to the easternmost Sky Station sculpture. After further investigation it was determine that a recent lightning strike was the reason for this damage to the artwork; and

 

WHEREAS, the study also suggested that the easternmost Sky Station will need to be removed from the pylon, disassembled, and repaired or replaced at a fabrication shop, and reinstalled on the pylon; and

 

WHEREAS, the original design and crafting of the Sky Stations, was completed by Artist R.M. Fischer; and

 

WHEREAS, pursuant to Section 3-7(a)(2) of the Code of Ordinances, the City Manager waived the solicitation requirements for a contract with A. Zahner Company to complete the removal, disassembly, fabrication, and re-installation work; and

 

WHEREAS, because A. Zahner Company was the fabricator of the original work that was completed in September of 1994, and was hired by the City to coordinate the engineering of the fabrication and installation of the original Sky Stations, it is in the best interest of the City to engage them in this re-construction and repair work; and

 

WHEREAS, the contract with A. Zahner Company to complete this project is estimated at $1,300,000.00, and the work to repair this damage is fully covered by the City’s insurance policy with Zurich Insurance Group so that once the project is complete the insurance funding is anticipated to reimburse the City account; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the revenue in the following account of the Capital Improvements Fund is hereby estimated in the following amount:

 

16-3090-077700-485160 Recovery of Insured Losses $1,050,000.00

 


Section 2. That the sum of $1,600,000.00 is hereby appropriated from the Unappropriated Fund Balance in the Capital Improvements Fund to the following account:

 

16-3090-077700-B-07001210 Bartle Hall Sky Stations $1,600,000.00

 

Section 3. That the Director of General Services is hereby designated as requisitioning authority for Account No. 16-3090-077700.

 

Section 4. That it is in the City’s best interest to contract with A. Zahner Company, as the fabricator and general contractor of such site and fabrication shop work for the repairs to the Sky Station and as the original team to have developed these works of art that have become a symbolic and iconic part of the Kansas City skyline, to assist the City with this project.

 

Section 5. That the Director of the General Services Department is authorized to enter into a $1,300,000.00 contract with A. Zahner Company for removal, fabrication, and re-installation work for the Sky Station, and can amend this contract without further City Council approval in the amount of up to $300,000.00.

 

Section 6. That this ordinance, appropriates money, and is recognized as an ordinance with an accelerated effective date as provided by Section 503(a)(3)(C) of the City Charter and shall take effect in accordance with Section 503, City Charter.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
