ORDINANCE NO. 910275

 

Amending Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 65.010A2371, rezoning an area of approximately 5.2 acres located on the west side of N. Oak Trafficway at N.E. 39th Street (extended) from Districts R-4 (Low Apartment) and C-3a1-p (Intermediate Business - Low Buildings - Limited District) to District C-3a1-p (Intermediate Business - Low Buildings - Limited District), and approving a preliminary plan for the same. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance is hereby amended by enacting a new section to be known as Section 65.010A2371, rezoning an area of approximately 5.2 acres located on the west side of N. Oak Trafficway at N.E. 39th Street (extended) from Districts R-4 (Low Apartment) and C-3a1-p (Intermediate Business - Low Buildings - Limited District) to District C-3a1-p (Intermediate Business - Low Buildings - Limited District), said section to read as follows:

 

Section 65.010A2371. That an area legally described as:

 

PARCEL "A": All of Lot #1, CHEZIK ADDITION, a subdivision in Kansas City, Clay County, Missouri.

 

PARCEL "B": All that part of the Southeast 1/4 of the Southeast 1/4 of the Southwest 1/4 of Section 2, Township 50, Range 33, in Kansas City, Clay County, Missouri, described as follows: Commencing at a point along the south line of said 1/4, 1/4, 1/4 Section 200' west of the Southeast corner of said 1/4, 1/4, 1/4, Section, which point being the point of beginning; thence north along a line parallel to the west right of way line of North Oak Trafficway as now established a distance of 182.6' M/L; thence N 8848'41" W a distance of 138' M/L; thence south along a line parallel to the west right of way line of North Oak Trafficway a distance of 82.6' M/L; thence south along a line parallel to the west right of way line of North Oak Trafficway a distance of 100' M/L; thence S 8938'20" E along the south line of said 1/4, 1/4, 1/4 Section a distance of 138' M/L to the point of beginning; except a tract of land in the southwest corner of the above described tract being 50' in width in an east west direction and 100' in a north south direction.

 

is hereby rezoned from Districts R-4 (Low Apartment) and C-3a1-p (Intermediate Business - Low Buildings - Limited District) to District C-3a1-p (Intermediate Business - Low Buildings - Limited District), all as shown outlined on a map marked Section 65.010A2371, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 65.010 thereof.

 

Section B. That a preliminary plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer construct a sidewalk along the west side of North Oak.

 

2. That the developer cause the area to be platted in accordance with Chapter 31, Code of General Ordinances,

as amended, commonly known as the Subdivision

Regulations.

 

3. That the developer remove outdoor speakers.

 

4. That the developer provide a detailed landscaping plan to include replacement of dead/dying trees as part of the

final plan for review and approval by the City Plan

Commission.

 

A copy of said preliminary plan is on file in the Office of the City Clerk under Document No. 910275, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
