COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 050469

 

Approving the Plat of Boulevard Brewing First Plat, an addition in Kansas City, Jackson County, Missouri; accepting and releasing various easements; establishing grades on public ways; authorizing the Director of Public Works to execute certain agreements, and authorizing the City Clerk to file this ordinance and attached Agreement.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the plat of BOULEVARD BREWING FIRST PLAT, a subdivision in Jackson County, Missouri, a true and correct copy of which is attached hereto and incorporated herein by reference is hereby approved.

 

Section 2. That the plat granting and reserving unto Kansas City an easement and license or right to locate, construct, operate and maintain facilities including, but not limited to, water, gas, sewerage, telephone, cable, TV, surface drainage, underground conduits, pad mounted transformers, service pedestals, any and all of them upon, over, under and along the strips of land outlined and designated on the plat by the words utility easement or U/E be and the same are hereby accepted and where other easements are outlined and designated on the plat for a particular purpose, be and the same are hereby accepted for the purpose as therein set out.

 

Section 3. That all right, title and interest in portions of general utility easements retained as part of the vacation of rights-of-way approved by Committee Substitute for Ordinance No. 050338 passed March 31, 2005, and recorded as Document No. 2005K0022495, more specifically described as being located in:

 

Portion of General Utility Easement to be released in Vacated SW/NE Alley:

 

All that part of the vacated alley abutting Lots 42 through 46, Block 4, Gates Addition, a subdivision in the Southeast Quarter of Section 7, Township 49 North, Range 33 West, in Kansas City, Jackson County, Missouri, described as follows:

 

COMMENCING at the Northeast corner of Lot 33, Block 4, Gates Addition, said point also lying on the West right of way line of vacated Belleview Avenue; thence South 2 degrees 13 minutes 09 seconds West along the West right of way line of said vacated Belleview Avenue a distance of 92.66 feet to the point of intersection with the Easterly line of a vacated alley; thence South 34 degrees 57 minutes 43 seconds West along the Easterly line of said vacated alley a distance of 172.09 feet to the POINT OF BEGINNING; thence continuing South 34 degrees 57 minutes 43 seconds West along the Easterly line of said vacated alley a distance of 89.49 feet to a point; thence North 55 degrees 02 minutes 17 seconds West a distance of 14.00 feet to a point on the Westerly line of the said vacated alley; thence North 34 degrees 57 minutes 43 seconds East along the Westerly line of said vacated alley a distance of 89.49 feet to a point; thence South 55 degrees 02 minutes 17 seconds East a distance of 14.00 feet to the POINT OF BEGINNING and containing 1,253 Square Feet or 0.029 Acres, more or less; and

 

5 General Utility Easement to be released in Vacated Belleview Avenue:

 

All that part of vacated Belleview Avenue right of way abutting Block 4, Gates Addition, a subdivision in the Southeast Quarter of Section 7, Township 49 North, Range 33 West, in Kansas City, Jackson County, Missouri, described as follows:

 

COMMENCING at the Northeast corner of Lot 33, Block 4, Gates Addition, said point also lying on the West right of way line of vacated Belleview Avenue; thence South 2 degrees 13 minutes 09 seconds West along the West right of way line of said vacated Belleview Avenue a distance of 92.66 feet to the POINT OF BEGINNING; thence South 87 degrees 46 minutes 53 seconds East a distance of 5.00 feet to a point; thence South 2 degrees 13 minutes 09 seconds West a distance of 539.76 feet to a point on the Easterly prolongation of the South line of Lot 20, Block 4 of said Gates Addition; thence North 87 degrees 20 minutes 34 seconds West along said prolongation a distance of 5.00 feet to the Southeast corner of said Lot 20, said point also lying on the West right of way line of vacated Belleview Avenue; thence North 2 degrees 13 minutes 09 seconds East along the West right of way line of vacated Belleview Avenue a distance of 539.73 feet to the POINT OF BEGINNING and containing 2,699 Square Feet or 0.062 Acres, more or less; and

 

All of the General Utility Easements to be released in the vacated North/South Alley and the eastern stub of East/West Alley south of Lot 27:

 

All of the included alley West of Lots 7 through 20, East of Lots 21 and 27 through 32, North of Lots 21 through 22 and South of Lot 27 inclusive, all lying in Block 4, Gates Addition, a subdivision in the Southeast Quarter of Section 7, Township 49 North, Range 33 West, in Kansas City, Jackson County, Missouri, described as follows:

 

BEGINNING at the Southeast corner of Lot 21, Block 4, Gates Addition; thence North 2 degrees 13 minutes 09 seconds East along the East line of said Lot 21 a distance of 121.70 feet to the Northeast corner of said Lot 21; thence North 87 degrees 20 minutes 34 seconds West along the North line of Lots 21 and 22 of said Block 4 a distance of 50.59 feet to the Southeast corner of a vacated alley as described in Book B2151 at Page 78; thence North 2 degrees 13 minutes 09 seconds East along the East line of said vacated alley a distance of 14.00 feet to the Northeast corner thereof, said point lying on the South line of Lot 27 of said Block 4; thence South 87 degrees 20 minutes 34 seconds East along the South line of said Lot 27 a distance of 50.59 feet to the Southeast corner thereof; thence North 2 degrees 13 minutes 09 seconds East along the East line of Lots 27 through 32 of said Block 4 a distance of 185.24 feet to the Northernmost corner of said Lot 32; thence North 34 degrees 57 minutes 43 seconds East along the East line of an existing alley a distance of 27.73 feet to the West-Northwest corner of Lot 7 of said Block 4; thence South 2 degrees 13 minutes 09 seconds West along the West line of Lots 7 through 20 inclusive of said Block 4 a distance of 344.38 feet to the Southwest corner of said Lot 20, said point also lying on the North right of way line of 26th Street; thence North 87 degrees 20 minutes 34 seconds West along the North right of way line of 26th Street a distance of 15.00 feet to the POINT OF BEGINNING and containing 5,698 Square Feet or 0.131 Acres, more or less.

be and the same are hereby released to the respective owners, their successors or assigns.

 

Section 4. That all right, title and interest in the sewer easement retained as a part of the vacation of the western portion of the East/West Alley right-of-way approved and recorded on October 29, 1920 as Document 1459437 in Book B-2151 at Page 78, be and the same are hereby released to the respective owners, their successors or assigns.

 

Section 5. That the grades of the streets and other public ways set out on the plat, herein accepted, are hereby established at the top of curb, locating and defining the grade points, which shall be connected by true planes or vertical curves between such adjacent grade points, the elevations of which are therein given, in feet above the City directrix.

 

Section 6. That the City Clerk is hereby directed to file copies of this ordinance, in the Office of the Secretary of the State of Missouri and in the Office of the Recorder of Deeds of Jackson County, Missouri together with all other relevant documents.

 


Section 7. That the Council finds that the City Plan Commission has duly endorsed its approval of this Ordinance hereon.
