COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 900590

 

Approving a community unit project for a tract of land consisting of approximately 19 acres located at the southeast corner of The Paseo and 45th Street.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a community unit project for a tract of land consisting of approximately 19 acres located at the southeast corner of The Paseo and 45th Street, more specifically described as:

 

All that part of the southeast 1/2 of the northwest 1/4 of Section 28, Township 49, Range 33, in Kansas City, Jackson County, Missouri, which is bounded by 45th Street on the north; by Woodland Avenue on the east; by Brush Creek Parkway on the south; by The Paseo on the west, as all are now established; except a tract of land more particularly described as follows: Beginning at a point, said point being the intersection of the easterly line of The Paseo, as now established with the northerly line of Brush Creek Parkway, as now established; thence north along the east line of The Paseo, a distance of 630.00 feet to a point; thence east with a deflection angle of 90 00'00" to the right from the last described course, a distance of 100.00 feet to a point; thence south and parallel to the east line of said street with a deflection angle of 90 00'00" to the right from the last described course, a distance of 176.38 feet to a point; thence east with a deflection angle of 90 00'00" to the left from the last described course, a distance of 120.00 feet to a point; thence south and parallel to the east line of said street with a deflection angle of 90 00'00" to the right from the last described course, a distance of 438.44 feet to a point on the northerly line of Brush Creek Parkway, as now established; thence southwesterly along the northerly line of said Parkway following a curve bearing to the right having a radius of 895.37 feet, a distance of 98.77 feet to a point of tangent; thence westerly along said tangent, a distance of 121.90 feet to the point of beginning. Subject to the rights of the public in 46th Street. Containing 19.16 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer submit a final plat in accordance with the provisions of Chapter 31, Code of General Ordinances

of Kansas City, Missouri, commonly known as the

Subdivision Regulations.

 

2. That the developer pay money in lieu of parkland dedication in the amount of $10,000.00 in satisfaction of

Section 31.32.

 


3. That the developer construct sidewalks along 45th Street and Woodland Avenue and replace curbs to City standards

along 46th Street as necessary.

 

4. That the Developer provide access for the Fire Department to the driveway from 45th Street.

 

 

A copy of said project is on file in the office of the City Clerk under Document No. 900590, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
