ORDINANCE NO. 080821

 

Approving the plat of Saint Lukes Hospital of Kansas City, an addition in Jackson County, Missouri; releasing various easements; establishing grades on public ways; authorizing the Director of City Development to execute and/or accept certain agreements; and authorizing the City Clerk to record this ordinance and attached documents. (SD1179A)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the plat of Saint Lukes Hospital of Kansas City, a subdivision in Jackson County, Missouri, a true and correct copy of which is attached hereto and incorporated herein by reference, is hereby approved.

 

Section 2. That all right, title and interest in the following recorded easements be and the same are hereby released to the respective owners, their successors or assigns, over that part of aforesaid easement under the following:

 

1. Utility easements reserved in and building restrictions imposed on vacated W. 44th Street herein described by vacation Ordinance No. 35003, passed March 15, 1968, recorded in Book K-32 at Page 1024 as Document No. K-14221. (Easement to be released in entirety.)

 

2. Two parallel and adjacent ten-foot water main easements through and under the North 20 feet of the South 28 feet of vacated W. 44th Street from the East line of Broadway to the West line of Wornall Road granted in, and building restrictions imposed on said premises by Ordinance No. 35201 and recorded in the instruments dated March 6, 1968, and March 4, 1968, in Book K-41 at Pages 1830, 1832 and 1834, filed May 7, 1968, under Document No. K-17489. (Each easement to be released in entirety.)

 

3. Easement for Water Main and Appurtenances granted to Kansas City as described in the document recorded in Book K-609 at Page 1906 as Document No. K-266704. (Easement to be released in entirety.)

 

4. Sidewalk easement over the North 6 feet of LOT 1, St. Lukes Hospital Addition, as established by the Document filed as No. K-648954, in Book K-1393, at Page 696, which was recorded in Book K-1401, at Page 1565, as Document No. K-653349. (Easement to be released in entirety.)

 

5. Temporary easement for maintaining, operating, serving and repairing an electrical transformer and pad located on the land, as reserved in the instrument recorded in Book K-1668, at Page 916, as Document No. K-770665. (Easement to be released in entirety.)

 

6. Easements, if any, for public utilities installed in, under or upon the vacated W. 44th Street Terrace prior to the vacation thereof and for which no notice appears in the public record and as reserved in Ordinance No. 031217, a copy of which was recorded July 28, 2004, as Document No. 2004K0050716. (Easements, if any, are to be released in entirety.)

 

7. Easements, if any, for public utilities installed in, under or upon that part of Wornall Road that has been vacated prior to the vacation thereof and for which no notice appears in the public record and as reserved in Ordinance No. 031218 passed November 13, 2003, a copy of which was recorded May 11, 2004, as Document No. 2004K0030657 vacating same. (Portion of easement to be released as shown hereon.) Release of the easements in vacated Wornall Road, being a portion of the vacated right-of-way as described in said Ordinance No. 2004K0030657, is more particularly described as follows:

 

A tract of land in the Northwest Quarter of the Northwest Quarter of Section 29, Township 49 North, Range 33 West in Kansas City, Jackson County, Missouri, said tract of land being a portion of vacated Wornall Road as set forth by Ordinance No. 031218 and filed for record May 11, 2004, as Document No. 2004K0030657 in the Office of the Recorder of Deeds in said City, County and State and said tract of land being more particularly described as follows: Commencing at the Southwest corner of Lot 3, Pearses 2nd Addition, a subdivision in said City, County and State according to the recorded plat thereof, being also the intersection of the East right-of-way line of Wornall Road with the North right-of-way line of West 45th Street Way, as said rights-of-way are now both established; thence North 02 degrees 23 minutes 22 seconds East along the West line of said Lot 3, being also along the East right-of-way line of said Wornall Road, a distance of 24.99 feet, more or less, to the point of intersection with the Easterly prolongation of the North right-of-way line of West 45th Street, as now established, said point being the Southeast corner of said vacated Wornall Road; thence continuing North 02 degrees 23 minutes 22 seconds East along the West line of Lots 3, 2 and 1 of said Pearses 2nd Addition, being also along the West line of Lots 16 and 17 of South Moreland Plat No. 2, a subdivision in said City, County and State according to the recorded plat thereof and being along the East line of said vacated Wornall Road, a distance of 371.00 feet to the Point of Beginning of the tract of land to be herein described; thence continuing North 02 degrees 23 minutes 22 seconds East along the West line of said Lot 17, being also along the East line of said vacated Wornall Road, a distance of 97.80 feet to the Northwest corner of said Lot 17; thence North 87 degrees 33 minutes 52 seconds West along the Westerly prolongation of said Lot 17, being also along a jog in the East line of said vacated Wornall Road, a distance of 0.59 feet; thence North 02 degrees 23 minutes 22 seconds East along the East line of said vacated Wornall Road, a distance of 226.36 feet; thence North 00 degrees 46 minutes 06 seconds East along the East line of said vacated Wornall Road, a distance of 404.46 feet to an angle point in the East line of said vacated Wornall; thence North 89 degrees 10 minutes 09 seconds West, no longer along the East line of said vacated Wornall Road, a distance 55 feet to an angle point in the West line of said vacated Wornall Road; thence South 01 degree 25 minutes 05 seconds West along the West line of said vacated Wornall Road, a distance of 378.80 feet to a point on the North line of vacated 44th Street, said point being 44.5 feet North of the Northeast corner of Lot 1, St. Lukes School of Nursing, a subdivision in said City, County and State according to the recorded plat thereof, thence South 02 degrees 23 minutes 22 seconds West (South 02 degrees 19 minutes 27 seconds West, Plat) along the West line of said vacated Wornall Road, being also along the East line of said Lot 1, a distance of 348.18 feet to a point 371.00 feet North of the North right-of-way line of said West 45th Street, as measured perpendicular to the North line thereof; thence South 87 degrees 34 minutes 26 seconds East along a line 371.00 feet North of and parallel with the North right-of-way line of said West 45th Street, a distance of 60.59 feet to the point of Beginning. Containing 42,636 square feet or 0.979 acres, more or less.

 

Section 3. That the grades of the streets and other public ways set out on the plat, herein accepted, are hereby established at the top of curb, locating and defining the grade points which shall be connected by true planes or vertical curves between such adjacent grade points, the elevations of which are therein given, in feet above the City Directrix.

 

Section 4. That the Director of City Development is hereby authorized to execute an Unsecured Deferral Agreement for Right-of-Way Dedication, to be in a form substantially as that attached hereto as Exhibit A and incorporated herein by reference.

Section 5. That the Director of City Development is hereby authorized to execute and/or accept any and all agreements necessary to clear the title of any right of way, utility easements or other public property dedicated on the plat.

 

Section 6. That the City Clerk is hereby directed to record copies of this ordinance, together with the documents described herein and all other relevant documents, when the plat has been released for recording, in the Office of the Recorder of Deeds of Jackson County, Missouri.

 

Section 7. That the Council finds that the City Plan Commission has duly endorsed its approval of this Ordinance hereon.
