COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 190569

 

Rezoning a portion of the area known as the West Bottoms generally located along 9th Street between State Line Road on the west, St. Louis Avenue on the south, Santa Fe Street on the east, and W. 8th Street on the north, from Districts M1-5, M3-5 and DX-7, to District DX-10. (CD-CPC-2019-00134)

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning and Development Code, is hereby amended by enacting a new section to be known as Section 88-20A1208, rezoning an area generally located along 9th Street between State Line Road on the west, St. Louis Avenue on the south, Santa Fe Street on the east, and W. 8th Street on the north, from Districts M1-5 (Manufacturing 1, Dash 5), M3-5 (Manufacturing 3, Dash 5) and DX-7 (Downtown Mixed Use, Dash 7) to District DX-10 (Downtown Mixed Use, Dash 10), said section to read as follows:

 

Section 88-20A1208. That an area legally described as:

 

1213 W. 8th Street and 802 W. 8th Street:

 

TRACT 1: Lots 6, 7, 8, 9, 10 and 11, Block 26, West Kansas, commonly known as west Kansas Addition No. 1, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

TRACT 2: Lots 12, 13 and 14 and that part of Lot 15 and 16 that lies northerly of the right-of-way of the St. Louis-San Francisco Railway Company (sometimes designated Eighth Street Alley Track) granted and described in deed dated August 29, 1902 in Book b-835 at page 214, Document no. 424956, the northerly line of which right-of-way runs from a point in the east lot line that is to the right, with a radius of 312.10 feet, to the southwest corner of said Lot 16, Block 26, West Kansas, commonly known as West Kansas Addition No. 1, a subdivision in Kansas City, Jackson County, Missouri.

TRACT I: All that part of Block 7, Pacific Place, described as follows: Beginning at a point on the east line of vacated Nero Street formerly Cedar Street 459.64 feet south of the south line of 9th Street; thence south along east line of vacated Nero Street 81.6 feet to the north line of an alley; thence northeasterly along north or northerly line of said alley 165.12 feet to a point 457.33 feet south of the south line of 9th Street; thence west 143.65 feet to point of beginning, said tract being that heretofore conveyed or meant to be conveyed by deeds of record in the Office of the Recorder of Deeds of Jackson County as Lots 1 and 2, Block 7, Pacific Place, a subdivision in Kansas City, Jackson County, Missouri, together with the east half of vacated Nero Street lying west of and adjacent to said tract.
