ORDINANCE NO. 930023

 

Approving and authorizing settlement of a lawsuit by Michael R. Mulvaney, Teresa Mulvaney, and Auto Owners Mutual Insurance Company against Kansas City, Missouri for property damage following a house fire at or near 4600 N. Oakley, Kansas City, Clay County, Missouri, on April 11, 1987.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That settlement of a lawsuit by Michael R. Mulvaney, Teresa Mulvaney, and Auto Owners Mutual Insurance Company against Kansas City, Missouri for any and all damages resulting from a house fire at or near 4600 N. Oakley, Kansas City, Clay County, Missouri, on or about April 11, 1987, more fully set forth and the subject of the lawsuit, Case No. CV190-6954-CC, now pending in the Circuit Court of Clay County, Missouri, by payment to Michael R. Mulvaney, Teresa Mulvaney, and Auto Owners Mutual Insurance Company the sum of $30,000.00 is recommended by the City Attorney and is hereby approved.

 

Section 2. That the City Attorney is hereby authorized to pay the sum of $30,000.00 in settlement of said claim and from funds heretofore appropriated in the General Liability Claims Fund, Account No. 701-013-1521-B-1820.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
