ORDINANCE NO. 080182

 

Approving the preliminary plat of Medical Plaza North on approximately 1.5 acres generally located on the north side of 43rd Street, east of Washington, and west of Wornall. (SD1372)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Medical Plaza North on approximately 1.5 acres generally located on the north side of 43rd Street, east of Washington, and west of Wornall, and more specifically described as follows:

 

All of Lot 1 and all that part of Lot 2, except the North 16.75 feet thereof which is now in vacated 42nd Street Terrace, Edmund Prices Addition to the Town of Westport, now Kansas City, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof, together with the vacated 10 feet of Washington Street lying West of and adjoining said premises and all of the vacated 16.50 feet wide alley lying East of and adjoining said Lots 1 and 2, also including a portion of the Southwest Quarter of the Southwest Quarter of Section 20, Township 49N., Range 33W., all being more particularly described as follows: Commencing at the Southwest Corner of said Quarter, Quarter Section, thence North 02 degrees 35 minutes 20 seconds East along the Westerly line of said Quarter, Quarter Section, a distance of 10 feet to a point on the Northerly right-of-way line of West 43rd Street, as now established, said point being the Southeast corner of said vacated 16.50 feet wide alley and the Point of Beginning of the tract of land to be herein described; thence North 87 degrees 15 minutes 50 seconds West along said Northerly right-of-way line, being also along the Southerly line of said vacated 16.50 feet wide alley and also along the Southerly line of said Lot 1 and its Westerly extension, a distance of 224.50 feet, more or less, to a point 10 feet West of the Westerly line of said Lot 1, as measured perpendicular to the Westerly line thereof, said point being on the Easterly right-of-way line of Washington Street, as now established; thence North 02 degrees 32 minutes 42 seconds East along a line 10 feet West of and parallel with the Westerly line of said Lots 1 and 2, being also along said Easterly right-of-way line; a distance of 180.53 feet, more or less, to a point on the Southerly line of vacated 42nd Street Terrace, said point being 16.75 feet South of the Westerly extension of the Northerly line of said Lot 2, as measured perpendicular to the Northerly line of said Lot 2; thence South 87 degrees 28 minutes 18 seconds East along said Southerly line, being also along a line 16.75 feet South of and parallel with the Northerly line of said Lot 2 and its Westerly and Easterly extension, a distance of 224.61 feet, more or less, to a point on the Westerly line of said Quarter, Quarter Section; thence North 02 degrees 35 minutes 20 seconds East along the Westerly line of said Quarter, Quarter Section, being also along a jog in the Southerly line of said vacated 42nd Street Terrace, a distance of 2.25 feet; thence South 87 degrees 28 minutes 18 seconds East along said Southerly line, a distance of 73.07 feet to a point 69.93 feet West of the Westerly right-of-way line of Wornall Road, as now established, as measured along the Southerly line of said vacated 42nd Street Terrace, said point being the Northwest corner of the tract of land described in the Quit Claim Deed, filed September 16, 2003 in the Office of the Recorder of Deeds for said County and State as Document No. 2003K0072364; thence South 03 degrees 04 minutes 53 seconds West, along the Westerly line of the tract of land described in said Quit Claim Deed, a distance of 50.24 feet (50.11 feet Deed) to the Southwest corner of the tract of land described in said Quit Claim Deed; thence South 87 degrees 33 minutes 52 seconds East, parallel with the Southerly line of said Quarter, Quarter Section, being also along the Southerly line of the tract of land described in said Quit Claim Deed, a distance of 77.58 feet to a point on the Westerly right-of-way line of said Wornall Road, said point being 50.62 feet Southeasterly of the Southerly line of said vacated 42nd Street Terrace, as measured along the Westerly right-of-way line of said Wornall Road and being also the Southeast corner of the tract of land described in said Quit Claim Deed; thence South 05 degrees 36 minutes 32 seconds East along said Westerly right-of-way line, a distance of 134.56 feet, more or less, to a point on the Northerly right-of-way line of said 43rd Street, said point being 10 feet North of the Southerly line of said Quarter, Quarter Section, as measured perpendicular to the Southerly line thereof; thence North 87 degrees 33 minutes 52 seconds West along said Northerly right-of-way line, 10 feet North of and parallel with the Southerly line of said Quarter, Quarter Section, a distance of 169.37 feet to the Point of Beginning. Containing 65,583 square feet or 1.505 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

(1)               That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

(2)               That the developer submit plans for grading and siltation and erosion control to the City Development Department, Development Services Division, for approval prior to beginning any construction activities.

 

(3)               That the developer secure a land disturbance permit from the City prior to beginning any construction, grading, clearing, or grubbing activities.

 

(4)               That the developer dedicate five (5) feet of additional right of way on the west side of Wornall Road between 43rd Street and Mill Street as required by Second Committee Substitute for Ordinance 030328 so as to provide a total of 30 feet of right of way as measured from the centerline of Wornall Road.

 

(5)               That the developer remove existing drive approaches not necessary for vehicular access into the parking lot (those formerly used for single-family residential).

 

(6)               That the developer submit a final plan to the City Plan Commission for approval, including plans for grading, landscaping, screening, berming, and signage.

 

A copy of the preliminary plat is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
