ORDINANCE

Approving the 7th & Main PIEA
General Development Plan on about 2.05 acres generally located west of Main
Street between 7th Street and 8th Street, and declaring the area a blighted and
insanitary area in need of redevelopment and rehabilitation pursuant to the
Missouri Planned Industrial Expansion Authority (PIEA) Law 100.300-100.620.

WHEREAS, the
Planned Industrial Expansion Authority of Kansas City, Missouri (“Authority”)
did prepare or cause to be prepared the 7th and Main PIEA General Development
Plan (“General Development Plan”) and recommended that the Council approve the
finding of blight and approve the General Development Plan for the area; and
WHEREAS, the
City Plan Commission has reviewed and recommended approval of the finding of
blight and the plan for the 7th and Main Planning Area (“Planning Area”) on
November 1, 2016, and recommended approval of the finding of blight for the
Planning Area and found the plan to be in conformance with the general plan for
the development of the community as a whole; and
WHEREAS, Section
100.400, RSMo, authorizes the Council to approve the General Development Plan
and a designation of blight if the Council finds that the plan is feasible and
in conformity with the general plan for the development of the community as a
whole; NOW, THEREFORE,
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section 1. That
the Council declares the area of approximately 2.05 acres generally located
west of Main Street between 7th Street and 8th Street, and more specifically
described by metes and bounds as follows:
710 Main Street: A
part of Lots 15, 16 and 17, Block 2, Coffman's Addition, all of Lots 17 and 18
and Lot 16, except the south 16.30 feet thereof, in Block 3, T.H. Swope's 2nd
Addition, a portion of the vacated north-south alley lying west of and
adjoining said Block 3, portions of Lots 14 to 27 inclusive, Ross &
Scarritt's Addition, and portions of vacated 7th Street and Delaware Street,
all more particularly described as follows: Beginning at a point on the
prolongation west of a line drawn 16.30 feet north of and parallel with the
south line of Lot 16, Block 3, in said T.H. Swope’s 2nd Addition, said point
beginning on the east line of Baltimore Avenue, as now established; thence North
0 degrees 08 minutes 10 seconds West, parallel with said east line, 175.79 feet
to the south line of 7th Street, as now established; thence South 89 degrees 56
minutes 10 seconds East along said south line and its prolongation east, 228.03
feet; thence easterly and southeasterly along a curve to the right from the
last described course as a tangent, having a radius of 38 feet, a distance of
9.00 feet to a point on the north line, 74.68 feet west of the northeast corner
of Lot 26, in Ross & Scarritt's Addition; thence continuing southeasterly
along the last described curve, 28.67 feet; thence continuing southeasterly and
southerly along a curve to the right, having a common tangent with the last
described curve and a radius of 79 feet, a distance of 44.29 feet thence South
01 degrees 01 minutes 20 seconds East, tangent to the last described curve,
123.06 feet; thence west 276 feet to point of beginning, all in Kansas City,
Jackson County, Missouri.
720 Main Street:
Parcel A: Lots 13,
14, 15 and the south 16.30 feet of Lot 16, Block 3, T.H. Swope's 2nd Addition,
and that part of the vacated alley lying west of and adjoining and lying east
of the east line of Baltimore Avenue, formerly Ann Street, as established by
Ordinance No. 5253 approved April 9, 1872, together with a part of Delaware
Street east and adjoining as vacated by Ordinance No. 41284 passed June 2,
1972, all in Kansas City, Jackson County, Missouri.
Parcel B: Lots 14
to 18, both inclusive, Ross and Scarritt's Addition, and that part of Lot 19 in
said addition lying south of the easterly prolongation of a line drawn 16.30
feet north at right angles from the south line of Lot 16, Block 3, in T.H.
Swope's 2nd Addition; together with that part of Delaware Street and 8th Street
lying south of said easterly prolongation as vacated by Ordinance No. 24054
passed July 2, 1959, and by Ordinance No. 41284 passed June 2, 1972, excepting
from the above described tract part of said lots now in Main Street.
All of Parcels A and
B being described by metes and bounds as follows:
All that part of the
Northwest 1/4 of Section 5, Township 49, Range 33, in Kansas City, Jackson
County, Missouri, including Lots 13, 14, 15 and the south 16.30 feet of Lot 16,
Block 3, T.H. Swope's 2nd Addition; Lots 14, 15, 16, 17, 18 and part of Lot 19,
Ross & Scarritt's Addition, together with parts of vacated streets and
alleys described by metes and bounds as follows: Beginning at a point on the
north line of 8th Street 48.50 feet west of the southeast corner of Lot 14,
Ross & Scarritt's Addition; thence South 5 degrees 54 minutes 50 seconds
West, 11.11 feet to a point on the north line of 8th Street as now established
by vacation Ordinance No. 24054 passed July 2, 1959, thence North 89 degrees 55
minutes 40 seconds West along the north line of 8th Street as so established,
52.17 feet; thence continuing along the north line of 8th Street to the
southeast corner of Lot 13, Block 3, T.H. Swope's 2nd Addition; thence North 89
degrees 55 minutes 40 seconds West along said lot line and the north line of
8th Street, 192 feet more or less, to the east line of Baltimore Avenue,
formerly Ann Street, as established by Ordinance No. 5253 approved April 9,
1872; thence north along said east line 148.36 feet more or less to a line
16.30 feet north at right angles from the south line of Lot 16, T.H. Swope's
2nd Addition; thence east along said parallel line and its prolongation across
vacated Delaware Street, and across Lot 19, Ross & Scarritt's Addition, to
the east line of said Lot 19; thence south along the east lines of Lots 19, 18,
17, 16, 15 and 14 to the southeast corner of said Lot 14, thence west along the
south line of said Lot 14, a distance of 48.50 feet to the point of beginning,
excepting from the above described tract part of said lots now in Main Street.
to be an insanitary or
undeveloped industrial area in need of industrial development as defined in
Section 100.310, RSMo, which constitutes an economic or social liability or a
serious and growing menace, which is injurious to the public health, safety,
morals, economy and welfare of the residents of Kansas City, and finds that the
elimination or prevention of the detrimental conditions in such area by the
commercial development of such area is necessary and in the interest of the public
health, safety, morals, economy and welfare of such residents.
Section 2. That
the 7th & Main PIEA General Development Plan prepared by the Authority and
recommended to the Council is intended to and shall affect and be applicable to
only the real property specifically described in Section 1 above and is hereby
approved. A copy of said General Development Plan is attached to this
ordinance and is made a part hereof.
Section 3. That
the Council has duly made the findings necessary for compliance with Section
100.300-100.620, RSMo.
Section 4. That
the General Development Plan is hereby found to be feasible and in conformance
with the general plan for the development of the community as a whole.
Section 5. That
the ad valorem tax exemption benefits as authorized in Section 100.570, RSMo,
are hereby extended to the plan area to the extent and in the manner as
provided for in said General Development Plan, and subject to the execution of
a development agreement with the Planned Industrial Expansion Authority of
Kansas City, Missouri, and the developer.
