ORDINANCE NO. 041321

 

Approving the plat of Kellybrook Third, an addition in Kansas City, Clay County, Missouri; accepting various easements; establishing grades on public ways; authorizing the Director of Public Works to execute a certain agreement; authorizing the Director of Public Works to accept certain agreements; and authorizing the City Clerk to file this ordinance and attached agreements.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the plat of Kellybrook Third, a subdivision in Kansas City, Clay County, Missouri, a true and correct copy of which is attached hereto and incorporated herein by reference is hereby approved.

 

Section 2. That the plat granting and reserving unto Kansas City an easement and license or right to locate, construct, operate and maintain facilities including, but not limited to, water, gas, sewerage, telephone, cable TV, surface drainage, underground conduits, pad mounted transformers, service pedestals, any and all of them upon, over, under and along the strips of land outlined and designated on the plat by the words utility easement or U/E be and the same are hereby accepted and where other easements are outlined and designated on the plat for a particular purpose, be and the same are hereby accepted for the purpose as therein set out.

 

Section 3. That various easements in Kansas City,, Clay County, executed by the following persons, and which appear of record as the instrument numbers and respective books and pages are hereby accepted for the purposed stated:

 

1.       Temporary Easement from Star Development Corporation, Instrument No. S9671, Book No. 4771, and Page No. 637.

 

2.       Temporary cul de sac Roadway Easement from Robertson, Inc., Instrument No. S96572, Book No. 4771, and Page No. 641.

3.       Storm Drainage Easement from Robertson Properties, Inc., Instrument No. S96573, Book No 4771, and Page No. 644.

 

4.       Temporary Easement from Robertson Properties, Inc., Instrument No. S96574, Book 4771, and Page No. 647.

 

5.       Standard Sewer Easement from Star Development Corporation, Instrument No. S96575, Book 4771, and Page No. 650.

 

6.       Standard sewer Easement from Star Development, Instrument No. S96576,

Book 4771 and Page No. 654.

 

7.       Temporary cul-de-sac Roadway Easement from Star Development CorporationBook No. S96577, Book 4771, and Page No. 658.

 

8.       Storm Drainage Easement from Star Development Corporation, Instrument No. S96578, Book No. 4771, and Page No. 661.

 

9.       Storm Drainage Easement from Star Development Corporation, Instrument No. S96579, Book No. 4771, and Page No. 664.

 

10.   Storm Drainage Easement from Star Development Corporation, Instrument No. S96580, Book 4771, and Page No. 667.

 

11.   Standard Sewer Easement from Hunt Midwest Real Estate Development, Inc., Instrument No. S96814, Book No. 4773, and Page No. 284.

 

12.   Temporary Easement from Hunt Midwest Real Estate Development, Inc., Instrument No. S96815, Book No. 4773, and Page 288.

 

13.   Temporary Easement from Hunt Midwest Real Estate Development, Inc., Instrument No. S96816, Book No. 4773, and Page No. 292.

 

14.   Storm Drainage Easement from Hunt Midwest Real Estate Development, Inc., Instrument No. S96817, Book 4773 and Page No. 296.

 

15.   Storm Drainage Easement from Hunt Midwest Real Estate Development, Inc., Instrument No. S96818, Book No. 4773, and Page No. 300.

 

16.   Conveyance of Easement for Surface Drainage from Star Development Corp., Instrument No. T00021, Book No. 4795, and Page 603.

 

Section 4. That the grades of the streets and other public ways set out on the plat, herein accepted, are hereby established at the top of curb, locating and defining the grade points which shall be connected by true planes or vertical curbs between such adjacent grade points, the elevations of which are therein given, in feet above the City Directrix.

 

Section 5. That the Director of Public Works is hereby authorized to execute a Covenant to Maintain Stormwater Detention Facility, to be in a form substantially as that attached hereto as Exhibit "A" and incorporated herein by reference.

Section 6. That the Director of Public Works is hereby authorized to accept a Deed of Release executed by Gold Bank, a Subordination of License or Easement between Aquila, Inc. and the City of Kansas City, Mo., and an Indemnification Agreement between Aquila Inc. and Star Development Corporation, to be in a form substantially as that attached hereto as Exhibit "A", Exhibit "B", and Exhibit "C", and incorporated herein by reference.

 

Section 7. That the City Clerk is hereby directed to file copies of this ordinance, together with the Covenant to Maintain Stormwater Detention Facility,, a Deed of Release executed by Gold Bank, a Subordination of License or Easement between Aquila, Inc. and the City of Kansas City, Mo., and an Indemnification Agreement between Aquila Inc. and Star Development Corporation, in the Office of the Secretary of State of Missouri and in the Office of the Recorder of Deeds of Clay County, Missouri together with all other relevant documents.

 

Section 8. That the Council finds that the City Plan Commission has duly endorsed its approval of this Ordinance hereon
