ORDINANCE NO. 910001
Amending Article VI of the Administrative Code by
repealing Section A6.64 thereof and enacting a new Section A6.64 of like number
and subject pertaining to the Silver Haired City Council.
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That Article VI of the Administrative
Code be amended by repealing Section A6.64 thereof and enacting a new Section
A6.64 of like number and subject, said new section to read as follows:
Sec. A6.64. Elections.
(a) A regular election shall be held between May 1
and May 31 of each year for the purpose of electing council members for the
succeeding term. The office of the city clerk shall conduct the annual
election and shall have the following duties:
(1) The preparation, printing and distribution
of
ballots and affirmation forms.
(2) The designation of the election date and
polling
hours. The polling hours shall be equal
in number
at all polling places, but need not be
identical.
(3) The designation of an equal number, not
less than
three (3) nor more than five (5), polling
places
per district.
(4) The publication of the list of candidates
along
with the date, time and place of the
election by
release of such information to the news
media not
less than ten (10) days before the
election.
(5) The supervision of the polling places.
(6) The collection of the ballots.
(7) The canvass of ballots, tabulation and
certification of results and disposition
of
ballots.
(b) Election of members representing the second,
fourth and sixth districts will be held in odd-numbered years beginning in May,
1985. Elections for members representing the first, third and fifth districts
will be held in even-numbered years beginning in May, 1986. Currently seated
members will serve the remainder of their terms of office.
(c) Each voter shall be entitled to vote for two
(2) candidates in the district in which the voter resides.
(d) The two (2) candidates in each district receiving
the greatest number of votes shall be deemed elected. The silver haired city
council and the city clerk shall make provisions for runoff elections in the
event of a tie.
(e) Costs of elections conducted under this
division shall be budgeted and paid as part of the budget for the silver haired
city council, to be included as a separate budgetary account in the office of
the city clerk.
(f) The silver haired city council shall provide
volunteers to staff the polling places and to assist the city clerk in
conducting annual silver haired city council elections.
(g) Electioneering, distributing election
literature, posting signs or parking or operating vehicles bearing signs with
respect to any candidate shall be prohibited on election day inside any
building at which a polling place is located or within twenty-five (25) feet of
such building's outer door closest to the polling place.
(h) Absente ballots and affirmation forms shall be
mailed to eligible voters upon written request to the city clerk. Completed
absentee ballots shall be returned to the city clerk on or before 5:00 p.m. on
the day of the election. Each ballot must be accompanied by an executed
affirmation form; otherwise the ballot shall not be counted.
(i) If there is only one (1) candidate for any
position on the silver haired city council, an election for that position shall
not be necessary and the sole candidate shall be declared elected. If there is
no candidate for a position on the silver haired city council, that position
shall be filled by appointment according to rules adopted by the silver haired
city council.
