Amending Chapter 70, Code of
Ordinances, by repealing Sections 70-785 and 70-786 relating to pedestrians and
enacting in lieu thereof two new sections of like number and subject.
BE IT ORDAINED BY THE COUNCIL OF
KANSAS CITY:
Section 1. That
Chapter 70, Code of Ordinances of the City of Kansas City, Missouri, is hereby
amended by repealing Sections 70-785 and 70-786 relating to pedestrians and
enacting in lieu thereof two new sections of like number and subject, to read
as follows:
Sec. 70-785. Pedestrians to use right half of crosswalks
and proceed without delay.
(a) Pedestrians
shall move, whenever practicable, upon the right half of crosswalks.
(b) No
pedestrian shall stop, stand or remain in any intersection or crosswalk for a
period longer than is necessary to safely traverse such intersection or
crosswalk.
Sec. 70-786. Pedestrians on
streets or highways.
(a) Where a
sidewalk is provided and its use is practicable, it shall be unlawful for any
pedestrian to walk along and upon an adjacent roadway.
(b) Where a
sidewalk is not available, any pedestrian walking along and upon a street or
highway shall walk only on a shoulder, as far as practicable from the edge of
the roadway.
(c) Where
neither a sidewalk nor a shoulder is available, any pedestrian walking along
and upon a street or highway shall walk as near as practicable to an outside
edge of the roadway, and, if on a two-way roadway, shall walk only on the left
side of the roadway.
(d) Except as
otherwise provided in this article, any pedestrian upon a roadway shall yield
the right-of-way to all vehicles upon the roadway.
(e) No
pedestrian shall stop, stand or remain on the following:
(1) Any portion of a controlled access or restricted access
highway; or,
(2) Any non-sidewalk area within three hundred feet of any
entrance or exit ramp leading to or from any portion of a controlled access or
restricted access highway.
(f) No
pedestrian shall stop, stand, or remain on or under any non-sidewalk portion of
a median, traffic island, traffic or highway divider, bridge, overpass or
viaduct for a period longer than is necessary to safely traverse an
intersection or crosswalk through or on such median, traffic island, traffic or
highway divider, bridge, overpass or viaduct.
(g) The
provisions of this section shall not apply to any pedestrian who is leaving,
approaching, attending to, or towing a disabled motor vehicle.
(h) The
provisions of this section shall not apply to government employees engaged in
the performance of their duties or to persons engaged in construction or
maintenance activities on behalf of a governmental agency or utility company.
