ORDINANCE NO. 961424
Approving an amendment to a previously approved Community
Unit Project on approximately a 695 acre tract of land generally bounded by
N.E. 96th Street on the south, N. Woodland Avenue on the east, N.E. 106th
Street on the north and N. Oak Trafficway on the west. (5406-CUP-15)
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That an amendment to a previously
approved Community Unit Project on approximately a 695 acre tract of land
generally bounded by N.E. 96th Street on the south, N. Woodland Avenue on the
east, N.E. 106th Street on the north and N. Oak Trafficway on the west, and
more specifically described as follows:
All that part of the South One-Half of the Southeast
Quarter of Section 26, Township 52, Range 33; all of the South One-Half of
the Southwest Quarter of Section 25, Township 52, Range 33, all of the
Northwest Quarter of Section 36, Township 52, Range 33; all of the
Southwest Quarter of Section 36, Township 52, Range 33; all of the
Northeast Quarter of Section 35, Township 52, Range 33 and all of the East
One-Half of the Southeast Quarter of Section 35, Township 52, Range 33 in the
City of Kansas City, Clay County, Missouri.
is hereby approved, subject to the following conditions:
1. That the developer cause the area to be platted
and processed in accordance with Chapter 66, Code of Ordinances of
the City of Kansas City, Missouri, as amended,
commonly known as the Subdivision Regulations.
2. That the developer submit a storm drainage
study to the City Engineer's Office for approval and that the
developer make any improvements as required by the City
Engineer's Office.
3. That the developer submit plans for grading and
siltation and erosion control to the City Engineer's Office for
approval prior to beginning any construction activities.
4. That the developer secure a land disturbance permit
from the Missouri Department of Natural Resources.
5. That the developer submit a street name sign
plan to the Street Naming Committee for approval prior to the
submittal of the first final plat.
6. That the developer extend water mains as
required by the Water Services Department.
7. That the developer extend sanitary sewers as
required by the Department of Public Works.
8. That the developer construct temporary
cul-de-sacs as required by the Department of Public Works.
9. That the developer install all-weather roads
and provide for fire protection as required by the Fire Department
prior to construction beyond footings and foundations.
10. That the developer construct N. Cherry Drive to
collector street standards as required by the Department of Public
Works.
11. That the developer construct sidewalks on the
east side of N. Cherry Drive from north of N.E. New Mark Drive to the
northern property line of the proposed multi-family
development as required by the Department of
Public Works.
12. That the developer dedicate additional right of
way for N.E. 96th Street as required by the Department of Public
Works so as to provide 50 feet of right of way as
measured from the centerline of N.E. 96th
Street.
13. That the developer dedicate additional right of
way for N.E. 106th Street as required by the Department of Public
Works so as to provide 30 feet of right of way as
measured from the centerline of N.E. 106th
Street.
14. That the developer dedicate additional right of
way for N. Woodland Avenue as required by the Department of Public
Works so as to provide 75 feet of right of way
as measured from the centerline of N. Woodland
Avenue.
15. That the developer improve one-half of N.E.
96th Street to primary arterial street standards as required by the
Department of Public Works, including sidewalks and
streetlights.
16. That the developer improve one-half of N.E.
106th Street to collector street standards as required by the
Department of Public Works, including sidewalks and streetlights.
17. That the developer improve one-half of N.
Woodland Avenue to parkway street standards as required by the
Department of Public Works, including sidewalks and
streetlights.
18. That the developer submit covenants, conditions
and restrictions for approval by the City for the private open space
with the final plat.
19. That the developer submit a street tree
planting plan as part of the final plat to the City Forester for
approval and to the Department of City Development and secure the
approval of the City Forester for street trees
planted on right of way in front of
residential lots.
20. That the developer submit final plans of the
private spaces for approval by the City Plan Commission.
21. That the developer contribute $53,628.00 in
lieu of parkland dedication for 361 single family lots in
satisfaction of Section 66-128 of the Subdivision Regulations.
22. That the developer submit a final plan for the
multi-family project area to the City Plan Commission for approval
including plans for landscaping, consisting of berms,
trees and plantings around and within the
parking lot. The final plan shall also show
proposed pedestrian circulation and elevation
drawings of signage.
A copy of said Community Unit Project amendment is on
file in the office of the City Clerk under Document No. 961424, which is
attached hereto and made a part hereof.
Section B. That the Council finds and declares that
before taking any action on the proposed Community Unit Project hereinabove,
all public notices and hearings required by the Zoning Ordinance have been
given and had.
