ORDINANCE NO. 130362

Approving the Petition to establish the Troost Avenue Community Improvement District; establishing the Troost Avenue Community Improvement District generally located on either side of Troost Avenue between Emanuel Cleaver II Boulevard on the north and 75th Street on the south in Kansas City, Jackson County Missouri; providing for the conditional performance of certain actions by the Troost Avenue Community Improvement District; and directing the City Clerk to report the creation of the District to the Missouri Department of Economic Development.

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the Petition to establish the Troost Avenue Community Improvement District (the “District”) as a political subdivision in accordance with Section 67.1401 through Section 67.1571, RSMo, otherwise known as the Missouri Community Improvement District Act (the “Act”), is hereby approved in its entirety.

Section 2. That the District is hereby established for the purposes set forth in the Petition, that the District shall have all the powers and authority authorized by the petition, the Act, and by law, and shall continue to exist in perpetuity following the effective date of this ordinance.

Section 3. That the District shall annually submit its proposed budget report and copies of written resolutions passed by the District’s board to the City pursuant to Section 67.1471, RSMo.

Section 4. That in the event the City Council approves a petition to establish a community improvement district, with the authority to levy a sales tax, generally encompassing the Troost corridor commencing at the northern boundary of the District at Troost Avenue, and extending north to include multiple blocks and multiple real property owners along Troost Avenue (the “North Troost CID”), then during any period of time after formation of the North Troost CID in which there is real property north of the centerline of 47th Street/Emmanuel Cleaver II Boulevard included within the District (the “Subject Property”), the District shall, as a condition of the City Council’s approval of formation of the District, contribute to the City no less frequently than semiannually all CID sales tax revenues generated by or from the Subject Property and received by the District (the “Subject Revenues”) during such time period. In such event, the City, subject to annual appropriation, intends to transfer an amount of funds equal to the Subject Revenues to the North Troost CID no less than semiannually for use by the North Troost CID for any lawful purpose. If the City Council does not approve a petition to establish the North Troost CID within fifteen (15) years of the effective date of this Ordinance, this Section 4 shall be of no further force and effect.


Section 5. That upon the effective date of this Ordinance, the City Clerk is hereby directed to report the creation of the District to the Missouri Department of Economic Development pursuant to Section 67.1421.6, RSMo, by sending copy of this ordinance to said agency.
