ORDINANCE NO. 051380

 

Approving the preliminary plat of 523 Grand Condominium on a 0.21 acre tract of land generally located at 523 Grand, northeast corner of Grand Boulevard and Missouri Avenue. (SD 1215)

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of 523 Grand Condominium on a 0.21 acre tract of land generally located at 523 Grand, northeast corner of Grand Boulevard and Missouri Avenue, and more specifically described as follows:

 

All that part of Lots 259 and 260, OLD TOWN, a subdivision of land in Kansas City, Jackson County, Missouri, being bounded and described as follows: Beginning at the Southwest corner of said Lot 260; thence North 143429 West, along the West line of said Lots 259 and 260, 105.00 feet; thence North 754413 East, 89.11 feet (88.5 more or less by deed) to a point on the Westerly right-of-way line of an alley, established by Ordinance No. 29344 as recorded in the Office of the Jackson County Recorder of Deeds; thence South 143429 East, along said Westerly right-of-way line, 105.00 feet to a point on the Northerly right-of-way line of Missouri Avenue, as now established; thence South 754413 West, along said right-of-way line, 89.11 feet (88.5 more or less by deed) to the Point of Beginning. Containing 9,356 square feet or 0.21 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer shall cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2. That the developer secure permits to repair sidewalks, curbs, and gutters as necessary along all development street frontages and the alleyway, unless the alleyway is vacated prior to the approval of the final plat, as required by the Department of Public Works in accordance with Chapters 56 and 64, Code of Ordinances.

 

3. That the developer submit covenants, conditions and restrictions to the Law Department for approval for the maintenance of common elements and private open space tracts.

 

4. That the developer provide for fire protection as required by the Fire Department.

 

5. That a 45 foot variance to the minimum required right of way width of 75 feet, as measured from the centerline for a parkway/boulevard, so as to permit 30 feet of right-of-way from the centerline of Grand Boulevard, as shown on the preliminary plat is hereby granted.

 

A copy of the preliminary plat is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
