ORDINANCE NO. 051516

 

Releasing various permanent and temporary easements in Kansas City, Jackson County; and directing the City Clerk to file this ordinance and attached agreements.

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That various easements be released in Kansas City, Jackson County, previously accepted for Project No. 3723, executed by the following persons, and which appear of record as the instrument numbers and respective books and pages as follows:

Section 2. That all right, title and interest in said easements accepted by Kansas City, be and the same are hereby released to the respective owners, their successors or assigns, over that part of aforesaid easements, and that the Director of Public Works, if so requested, is authorized to execute a Quit Claim Deed to the present owners, their successors or assigns, as further evidence thereof.

Section 3. That certain easements (also known as Tract No. 95) established by Ordinance No. 040368, passed April 08, 2004, by the City Council, and as set forth in the decree under Case No. 04CV225091, filed in the Circuit Court of Jackson County, Missouri, at Kansas City, as part of Lots 98, and 99 Bannister Acres Addition a subdivision of record in Kansas City, Jackson County, Missouri, and described as follows:

Permanent sewer easement

A part of Lots 98 & 99, Bannister Acres Addition, a subdivision in Kansas City, Jackson County, Missouri described as follows: A part of Lots 98 & 99, Bannister Acres Addition, a subdivision in Kansas City, Jackson County, Missouri described as follows: Commencing at the most Southeasterly corner of Lot 99; thence North 01 degrees 28 minutes 55 seconds East, a distance of 186.95 feet; thence North 88 degrees 01 minutes 55 seconds West, a distance of 168.86 feet; thence North 87 degrees 07 minutes 20 seconds West, a distance of 161.19 feet; thence North 01 degrees 28 minutes 51 seconds East, a distance of 15.00 feet; thence South 87 degrees 07 minutes 20 seconds East, a distance of 161.43 feet; thence South 88 degrees 01 minutes 55 seconds East, a distance of 168.61 feet; thence South 01 degrees 28 minutes 55 seconds West, a distance of 15.00 feet to the Point of Beginning. Containing 4,950.62 square feet (0.114 acres), more or less, except any part lying in existing utility easements. Basis of bearings are grid bearings.

 Temporary Construction easement

A part of Lots 98 & 99, Bannister Acres Addition, a subdivision in Kansas City, Jackson County, Missouri described as follows: Commencing at the most Southeasterly corner of Lot 99; thence North 01 degrees 28 minutes 55 seconds East, a distance of 169.45 feet to the Point of Beginning; thence North 88 degrees 01 minutes 55 seconds West, a distance of 169.14 feet; thence North 87 degrees 07 minutes 20 seconds West, a distance of 160.90 feet; thence North 01 degrees 28 minutes 51 seconds East, a distance of 50.01 feet; thence South 87 degrees 07 minutes 20 seconds East, a distance of 161.72 feet; thence South 88 degrees 01 minutes 55 seconds East, a distance of 168.32 feet; thence South 01 degrees 28 minutes 55 seconds West, a distance of 50.00 feet to the Point of Beginning, except that part included in standard sewer easement. Containing 11,551.45 square feet (0.265 acres), more or less, except any part lying in existing utility easements. Basis of bearings are grid bearings.

Section 4. That upon the effective date of this ordinance, the City Clerk is hereby directed to cause this ordinance and the Quit Claim Deed to be recorded in the Office of the Recorder of Deeds for Jackson County, Missouri with all other relevant documents.
