COMMITTEE SUBSTITUTE
FOR ORDINANCE NO. 100404
Repealing Section 2-1466, Code of
Ordinances, entitled “Missouri statewide court automation program surcharge”
reflecting the City’s withdrawal from its attempt to utilize the Office of
State Courts Administrator to provide a modern management system to the
municipal court; and authorizing termination of the Intergovernmental Agreement
between the Office of State Courts Administrator, the Kansas City Municipal
Division of the Circuit Court and the City of Kansas City, Missouri, dated
April 30, 2006.
WHEREAS, by
Ordinance No. 060357 the City Council authorized the City to enter into an
agreement with the Missouri Office of State Courts Administrator for the
provision of necessary hardware and integration of the Municipal Court into the
Missouri statewide court automation system; and
WHEREAS, OSCA and its
vendor have faced obstacles which cannot at this time be overcome, thus
preventing the integration of the Municipal Court into the statewide court
automation system; and
WHEREAS, the City
will seek an alternative from a source other than OSCA; and
WHEREAS, the $7.00
surcharge imposed by Section 2-1466, Code of Ordinances is authorized by state
statute only if the City uses the statewide court automation system; and
WHEREAS, since the
City will no longer attempt its integration into the statewide court automation
system the prerequisite for imposition of the charge no longer exists; NOW,
THEREFORE,
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section 1. That
Section 2-1466, Code of Ordinances, entitled “Missouri statewide court
automation program surcharge” is repealed.
Section 2. That the
Court Administrator is authorized to send a notice of termination of the
Intergovernmental Agreement between the Office of State Courts Administrator,
the Kansas City Municipal Division of the Circuit Court and the City of Kansas
City, Missouri, effective April 30, 2006, for the implementation and use of the
court automation software, Contexte.
