RESOLUTION NO. 120071

 

Designating a portion of the City’s share of Clay County’s special road and bridge tax receipts for calendar year 2011, in accordance with Section 137.556, Revised Statutes of Missouri, and directing the City Manager to transmit this resolution to Clay County.

 

WHEREAS, the City Council desires to use the City of Kansas City’s share of Clay County’s special road and bridge tax receipts to fund construction projects of mutual benefit to the City of Kansas City and Clay County; and

 

WHEREAS, Section 137.556 RSMo., states that the city council or other governing body of the city, town or village shall designate the roads, streets and bridges to be repaired and improved and shall specify the kinds and types of materials to be used; and

 

WHEREAS, the City Council desires to designate for repair and improvement the section of North Brighton Road from Highway 210 to Parvin Road; and

 

WHEREAS, the City Council, in Committee Substitute for Resolution No. 081249 passed June 11, 2009 designated the City’s share of Clay County special road and bridge tax receipts for calendar years 2008 and 2009 for design and right-of-way acquisition costs for the North Brighton Road improvement project; and

 

WHEREAS, the 2008-09 road and bridge tax funds only partially defrayed design and right-of-way acquisition costs for the North Brighton project, and the City Council, in Resolution No. 100770 designated the City’s share of Clay County special road and bridge tax receipts for calendar year 2010 to continue design work and right-of-way acquisition for the project; and

 

WHEREAS, the design work for the North Brighton project is completed and the right-of-way acquisition is nearly completed, with construction now planned to begin in May 2012; and

 

WHEREAS, in its Resolution No. 2011-03 adopted on March 14, 2011, the Clay County Commission authorized its County Treasurer to disburse annual road and bridge tax levy funds to Kansas City in the amount of $301,272.00; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY;

 

Section 1. That the City Council hereby designates, in accordance with Section 137.556, RSMo., that the City’s Three Hundred One Thousand Two Hundred Seventy Two Dollars ($301,272.00) share of Clay County, Missouri’s special road and bridge tax receipts for calendar year 2011 as authorized by Clay County Commission Resolution No. 2011-03 is to be used to pay a portion of the costs for the following road and bridge project:

 

a. Project: Construction to repair and improve North Brighton from a two-lane unimproved roadway section to a three-lane improved roadway section from Highway 210 to Parvin Road.

 

b. Estimated cost: Five Million Two Hundred Fifty Thousand Dollars ($5,250,000.00) for construction and related inspection services.

 

c. Construction of road improvements will begin in or about May 2012 using such materials as specified in City ordinance and contract for such project.

 

Section 2. That the City Manager is hereby instructed to transmit this resolution to Clay County, Missouri within 30 days of adoption.
