ORDINANCE NO. 041233

 

Approving a Special Use Permit in District R-1b on approximately a 0.41 acre tract of land generally located at the northwest corner of N.E. 35th Terrace and N. Myrtle Avenue to allow additional antennas on an existing telecommunications tower and for an additional equipment shelter building. (Case No. 310-S-1)

 

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a Special Use Permit in District R-1b (One-Family Dwellings, Medium Density) on approximately a 0.41 acre tract of land generally located at the northwest corner of N.E. 35th Terrace and N. Myrtle Avenue, and more specifically described as follows:

 

All of the south 51.3 feet of Lot 2, and all of Lot 3 lying easterly of the easterly right-of-way line of Chouteau Trafficway, North Kansas City Heights, a subdivision in Kansas City, Jackson County, Missouri..

 

is hereby approved to allow additional antennas on an existing telecommunications tower and for an additional equipment shelter building, subject to the following condition:

 

1. That the developer submit a storm drainage study to the City Engineers Office for approval for the entire development, and that the developer make any improvements as required by the City Engineers Office.

 

A copy of said Special Use Permit Plan is on file in the office of the City Clerk under Document No. 041___, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Special Use Permit hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
