ORDINANCE NO. 150836

 

Vacating a portion of Hilton’s Addition Plat and rights-of-way within the plat generally located south of N.E. Parvin Road, north of N.E. Lindenman Avenue, and east of N. Arlington Avenue; and directing the City Clerk to record certain documents. (1700-V)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Council of Kansas City does hereby find and declare that on the 28th day of July, 2015, a petition was filed with the City Clerk of Kansas City by Lutjen for the vacation of a portion of Hilton’s Addition Plat and rights-of-way within the boundaries of the plat, said portion of the plat being the following: All of Blocks 1, 2, 3 and 6, Hilton’s Addition, a subdivision in the Southeast Quarter of Section 2, Township 50 North, Range 32 West of the 5th Principal Meridian in Kansas City, Clay County, Missouri, being bounded and described as follows: Commencing at the Northeast corner of said Southeast Quarter; thence North 89 degrees 21 minutes 22 seconds West, along the North line of said Southeast Quarter, 915.75 feet to the point of beginning of the tract of land to be herein described; thence South 00 degrees 34 minutes 02 seconds West, 2,059.54 feet; thence North 89 degrees 09 minutes 32 seconds West, 72.60 feet; thence South 00 degrees 30 minutes 06 seconds West, 160.00 feet; thence North 89 degrees 09 minutes 32 seconds West, 218.90 feet; thence North 00 degrees 30 minutes 06 seconds East, 218.60 feet; thence North 89 degrees 09 minutes 32 seconds West, 72.63 feet; thence North 00 degrees 34 minutes 02 seconds East, 682.05 feet; thence North 89 degrees 18 minutes 49 seconds West, 31.81 feet; thence North 00 degrees 34 minutes 02 seconds East, 1,317.61 feet to a point on said North line; thence South 89 degrees 21 minutes 22 seconds East, along said North line, 396.00 feet to the point of beginning, containing 822,514 square feet or 18.88 acres, more or less, giving the distinct description of the right-of-way to be vacated, and also the names of the persons and corporations owning or claiming to own the property fronting thereon, and that the consent of the persons and corporations owning or claiming to own three-fourths of the front feet of the property immediately adjoining said right-of-way has been obtained in writing, that said consent has been acknowledged as deeds are acknowledged, and was duly filed with the petition for such vacation in the City Clerk's Office.

 

Section 2. That the Council finds that the City Plan Commission has duly endorsed its approval of this Ordinance hereon.

 

Section 3. That the Council finds that no private rights will be unreasonably injured or endangered by this vacation and that the public will suffer no unreasonable loss or inconvenience thereby.

 

Section 4. That a portion of Hilton’s Addition Plat and rights-of-way within the boundaries of the plat, said portion of the plat being the following: All of Blocks 1, 2, 3 and 6, Hilton’s Addition, a subdivision in the Southeast Quarter of Section 2, Township 50 North, Range 32 West of the 5th Principal Meridian in Kansas City, Clay County, Missouri, being bounded and described as follows: Commencing at the Northeast corner of said Southeast Quarter; thence North 89 degrees 21 minutes 22 seconds West, along the North line of said Southeast Quarter, 915.75 feet to the point of beginning of the tract of land to be herein described; thence South 00 degrees 34 minutes 02 seconds West, 2,059.54 feet; thence North 89 degrees 09 minutes 32 seconds West, 72.60 feet; thence South 00 degrees 30 minutes 06 seconds West, 160.00 feet; thence North 89 degrees 09 minutes 32 seconds West, 218.90 feet; thence North 00 degrees 30 minutes 06 seconds East, 218.60 feet; thence North 89 degrees 09 minutes 32 seconds West, 72.63 feet; thence North 00 degrees 34 minutes 02 seconds East, 682.05 feet; thence North 89 degrees 18 minutes 49 seconds West, 31.81 feet; thence North 00 degrees 34 minutes 02 seconds East, 1,317.61 feet to a point on said North line; thence South 89 degrees 21 minutes 22 seconds East, along said North line, 396.00 feet to the point of beginning, containing 822,514 square feet or 18.88 acres, more or less, be and the same is hereby vacated.

 

Section 5. That the City Clerk of Kansas City, Missouri, be and she is hereby authorized and directed to acknowledge this ordinance as deeds are acknowledged, and to cause this ordinance and the attached map to be filed for record in the Recorder's Office in Clay County, Missouri.

 

Section 6. All Ordinances or parts of Ordinances in conflict with this Ordinance are, in so much as they conflict with this Ordinance, hereby repealed.
