ORDINANCE NO. 170439

 

Calling an election to be held on November 7, 2017, to submit to the qualified voters of the City the questions of whether to authorize the construction of a new passenger terminal at the Kansas City International Airport and to authorize the issuance and sale of airport revenue bonds in an amount not to exceed $990,000,000.00 for these aviation and aviation related purposes; directing the City Clerk to notify the responsible election authorities of the election no later than August 29, 2017; mandating and establishing a competitive bidding process for any construction; and recognizing this ordinance as having an accelerated effective date.

 

WHEREAS, Section 6-50, Code of Ordinances, requires that any proposed demolition, construction or replacement of an existing passenger terminal at Kansas City International Airport or the construction of any new passenger terminal at KCI be presented to the qualified voters of the City of Kansas City, Missouri (“City”) for their consideration and approval before any such actions are taken; and

 

WHEREAS, the City is a constitutional charter city and political subdivision duly organized and existing under the laws of the State of Missouri which owns and operates a revenue producing airport system serving the City and its inhabitants and others; and

   

WHEREAS, pursuant to Section 27 of Article VI of the Missouri Constitution, the City must obtain the approval of the majority of the qualified voters voting on the question, in order to issue and sell revenue bonds for aviation related purposes, those purposes being to design and construct a new passenger terminal facility or reconstruct existing terminal(s); and

 

WHEREAS, the Council desires to submit such questions to the voters for their consideration; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. ELECTION CALLED. The terms of Section 6-50, Code of Ordinances notwithstanding, that an election is called on November 7, 2017, for the purpose of submitting to the voters of Kansas City the questions of whether to authorize the construction of a new passenger terminal at Kansas City International Airport (“KCI”), and to authorize the issuance and sale of airport revenue bonds in an amount not to exceed $990,000,000.00 for these aviation and aviation related purposes at KCI.

 

Section 2. BALLOT TITLE. The ballot title shall be:

 

Should the City of Kansas City be authorized to construct a new passenger terminal at Kansas City International Airport (“KCI”), and to issue and sell airport revenue bonds in an amount not to exceed $990,000,000.00 for the aviation and aviation related purposes of constructing a new passenger terminal at Kansas City International Airport?

 

Section 3. NOTICE OF ELECTION. The notice of election shall read as follows:

 

NOTICE OF ELECTION KANSAS CITY, MISSOURI

 

Notice is hereby given that the City of Kansas City has called a special election to be held on Tuesday, November 7, 2017, between the hours of 6:00 a.m. and 7:00 p.m., at which election all qualified voters residing within Kansas City, Missouri will be given the opportunity to vote.

 

The official ballot will be in substantially the following form:

 

OFFICIAL BALLOT CITY OF KANSAS CITY SPECIAL ELECTION, NOVEMBER 7, 2017

QUESTION NO. [_], (Authorization of KCI Terminal Modernization and Airport Revenue Bonds)

 

Should the City of Kansas City be authorized to construct a new passenger terminal  at Kansas City International Airport (“KCI”), and to issue and sell airport revenue bonds in an amount not to exceed $990,000,000.00 for the aviation and aviation related purposes of construction of a new passenger terminal facility at Kansas City International Airport; but, only if the general construction contract for a new passenger terminal results from a competitive bid or proposal process?

(Instructions to voters will be supplied by the election authorities.)

A full and complete copy of this ordinance (as it may be amended) submitting the above question to the electorate is on file in the office of the City Clerk of Kansas City, Missouri where the same is open for inspection and copying.

Section 4. NOTICE TO ELECTION AUTHORITIES BY CITY CLERK. That following passage of this ordinance the City Clerk shall deliver certified copies of this ordinance and notice of election to the Clerk of Cass County, Board of Election Commissioners of Clay County, Board of Election Commissioners of Kansas City, and Board of Election Commissioners of Platte County, no later than August 29, 2017, which shall be the authority of each election authority of the City to submit the question to the electors of Kansas City and to give public notice as provided by law.

 

Section 5. ACCELERATED EFFECTIVE DATE RECOGNIZED. This ordinance, providing for the submission of question to the people of Kansas City, Missouri, is hereby recognized to have an accelerated effective date within the meaning of Section 503(a)(3)(A) of the Charter, and as such shall take effect in accordance with Section 503.

 

Section 6.  AUTHORIZATION TO BEGIN COMPETITIVE BID PROCESS.  The terms of Sec. 6-50, Code of Ordinances notwithstanding, the Director of the Aviation Department is hereby authorized to initiate competitive processes for design-build proposals for the construction of a new passenger terminal facility.at the Kansas City International Airport

 

Any such requests for design build proposals to be issued by the Aviation Department shall be first approved by the City Council prior to issuance.
