RESOLUTION NO. 100984, AS AMENDED

 

Expressing the support of the Council for the physical relocation of the Port Authority from the offices of the Economic Development Corporation and for the transition of the Port Authority to management of its own operations; and instructing the City Manager to facilitate this transition.

 

WHEREAS, the Port Authority of Kansas City, Missouri (“Port Authority”) is an independent political subdivision of the State of Missouri, established in 1979 by operation of Chapter 68 of the Revised Statutes of the State of Missouri; and

 

WHEREAS, the Port Authority has been planning since May of 2010, in consultation with the Economic Development Corporation of Kansas City, Missouri (“Economic Development Corporation”), to effect its relocation and transition to self-management of its operations and officially resolved to effectuate the transition to self-managed operational status in July of 2010; and

 

WHEREAS, the Executive Committee of the Economic Development Corporation has requested direction from the City Council in connection with the relocation and transition of the Port Authority to self-managed operational status; and

WHEREAS, the Economic Development Corporation will continue to meet its ministerial obligations as fiscal administrative agent pursuant to the contractual commitments set forth in the current contract between the City of Kansas City, the Port Authority, the Economic Development Corporation, and other statutory agencies, with performance terminating on April 30, 2011, such contract being approved by the Council in Ordinance No.100590 (“Contract”); and

 

WHEREAS, recent state legislation granted to the Port Authority special purpose taxing authority which enhances the Port Authority as a public interest developer; and

 

WHEREAS, the new bond between the Economic Development Corporation and the Port Authority will benefit both agencies by fostering the opportunity for the Port Authority and the Economic Development Corporation to work together to implement the City Council’s goals for making the City of Kansas City more competitive for economic development opportunities; and

 

WHEREAS, the Port Authority will present to the City Council Business Session, quarterly or as requested by the City Manager, with the status of its revenues and activities; NOW THEREFORE,

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

That the Council supports the on-going physical relocation of the Port Authority from the headquarters of the Economic Development Corporation and transition of the Port Authority to management of its own operations, based upon the Council’s understanding that the Economic Development Corporation and the Port Authority will continue to observe their respective rights, duties and obligations as set forth in the applicable laws of the State of Missouri and in the Contract, in particular and insofar as those respective rights, obligations and duties provide that the Economic Development Corporation shall perform its ministerial functions as the fiscal administrative agent for the Port Authority until performance under the Contract terminates on April 30, 2011; and

 

BE IT FURTHER RESOLVED that the City Manager is instructed to facilitate this transition.
