COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 081146

 

Vacating a portion of St. Paul Avenue, Kansas City, Jackson County, Missouri; and directing the City Clerk to record certain documents. (1594-V)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. The Council of Kansas City does hereby find and declare that on the 2nd day of June, 2008, a petition was filed with the City Clerk of Kansas City by HD Lee Building, LLC, for the vacation of that part of the West half of St. Paul Avenue lying East of, and adjacent to, Lots 1, 2, 3 and the North 20 feet of Lot 4, Block 20, Goodrich Addition, a subdivision of land in Kansas City, Jackson County, Missouri, more particularly described as follows: Beginning at the Northeast corner of Lot 1 Block 20, in said Goodrich Addition said point being also on the south line of McGee Cemetery, as shown on the plat of said Goodrich Addition; thence East along the south line of said McGee Cemetery, a distance of 20.00 feet to the Centerline of St. Paul Avenue, as established by said plat; thence South along said centerline a distance of 39.05 feet: thence West at right angles to the last described course, a distance of 4.00 feet; thence South and parallel to said centerline, a distance of 56.00 feet to a point on the Easterly projection of the South line of the North 20 feet of Lot 4 in said Block 20: thence West along said extension, a distance of 16.00 feet to the Southeast corner of said North 20 feet of Lot 4; thence North along the East line of said Block 20. a distance of 95.00 feet to the point of beginning, all in Section 8, Township 49 North, Range 33 West, Kansas City, Jackson County, Missouri, giving the distinct description of the street to be vacated, and also the names of the persons and corporations owning or claiming to own the property fronting thereon, and that due notice of the pendency of said petition has been given in the newspaper doing the city printing, and that the consent of the persons and
corporations owning or claiming to own three-fourths of the front feet of the property immediately adjoining said street has been obtained in writing, that said consent has been acknowledged as deeds are acknowledged, and was duly filed with the petition for such vacation in the City Clerk's Office.

 

Section 2. That the Council finds that the City Plan Commission has duly endorsed its approval of this Ordinance hereon.

 

Section 3. That the Council finds that no private rights will be unreasonably injured or endangered by this vacation and that the public will suffer no unreasonable loss or inconvenience thereby.

 

Section 4. That the part of the West half of St. Paul Avenue lying East of, and adjacent to, Lots 1, 2, 3 and the North 20 feet of Lot 4, Block 20, Goodrich Addition, a subdivision of land in Kansas City, Jackson County, Missouri, more particularly described as follows: Beginning at the Northeast corner of Lot 1 Block 20, in said Goodrich Addition said point being also on the south line of McGee Cemetery, as shown on the plat of said Goodrich Addition; thence East along the south line of said McGee Cemetery, a distance of 20.00 feet to the Centerline of St. Paul Avenue, as established by said plat; thence South along said centerline a distance of 39.05 feet: thence West at right angles to the last described course, a distance of 4.00 feet; thence South and parallel to said centerline, a distance of 56.00 feet to a point on the Easterly projection of the South line of the North 20 feet of Lot 4 in said Block 20: thence West along said extension, a distance of 16.00 feet to the Southeast corner of said North 20 feet of Lot 4; thence North along the East line of said Block 20. a distance of 95.00 feet to the point of beginning, all in Section 8, Township 49 North, Range 33 West, Kansas City, Jackson County, Missouri, be and the same is hereby vacated All utility easements over, under, across and along said street are also hereby vacated.

 

Section 5. That the City Clerk of Kansas City, Missouri, be and she is hereby authorized and directed to acknowledge this ordinance as deeds are acknowledged, and to cause this ordinance and the consent of property owners hereinbefore referred to, to be filed for record in the Recorder's Office in Jackson County, Missouri.

 

Section 6. All Ordinances or parts of Ordinances in conflict with this Ordinance are, in so much as they conflict with this Ordinance, hereby repealed.
