Accepting approximately 10.01
acres of vacant land contiguous to San Rafael Park as an expansion to San
Rafael Park and declare it to be park property and to remain such forever in
accordance with the provisions of Section 1004 of the Charter as an addition to
the Kansas City, Missouri, Parks, Recreation and Boulevards System and
directing the City Clerk to record this ordinance and attached documents.
WHEREAS, it has
been the desire of the Board of Parks and Recreation Commissioners to enhance
and expand open space and recreation opportunities by adding additions to the
parks system; and
WHEREAS, San
Rafael Park, a 16.16 acre neighborhood park within the Gracemor neighborhood,
in Kansas City, Clay County, Missouri was acquired in 1968 and is generally
located at N.E. 53rd Street and San Rafael Drive; and
WHEREAS, a 10.01
acre parcel was purchased from the Catholic Diocese of Kansas City St. Joseph
as an addition to San Rafael Park, bringing the total size of the park to 26.17
acres; NOW, THEREFORE,
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section 1. That
the Council is requested to accept the deed to the following described land and
declare it to be park property and to remain such forever in accordance with
the provisions of Section 1004, of the Charter, as an addition to the Kansas
City, Missouri, Parks Recreation and Boulevards System. This tract being more
particularly described as follows:
A tract of land
being part of Lot A and Lot B, Gracemor, a subdivision of land in the Northwest
Quarter of Section 34, Township 51 North, Range 32 West, City of Kansas City,
Clay County, Missouri, being more particularly described as follows: Beginning
at the northeast corner of said Lot A, on the right-of-way line of the
southwest corner of the intersection of N. Sycamore Avenue and San Rafael
Avenue; thence along the southerly right-of-way line of San Rafael Avenue along
a curve to the left 91.00 feet, having a radius of 525.00 feet and a chord
bearing of South 32 degrees 27 minutes 53 seconds East; thence continuing along
said southerly right-of-way line, South 37 degrees 25 minutes 48 seconds East,
661.08 feet; thence along a curve to the right 187.67 feet, having a radius of
850.00 feet and a chord bearing of South 31 degrees 31 minutes 41 seconds East
to the northeast corner of Lot 10 Gracemor, Block 15; thence leaving said
right-of-way line along the northerly line of said Block 15, South 75 degrees 42
minutes 39 seconds West, 358.67 feet; thence South 80 degrees 34 minutes 07
seconds West, 129.01 feet; thence South 86 degrees 29 minutes 15 seconds West,
322.64 feet to a point on the easterly right-of-way line of N. Tullis Avenue;
thence leaving said northerly block line along said easterly right-of-way line
along a curve to the left 176.22 feet having a radius of 632.66 feet and a
chord bearing of North 26 degrees 18 minutes 45 seconds West; thence leaving
said easterly right-of-way line North 42 degrees 45 minutes 58 seconds East,
380.58 feet; thence North 47 degrees 26 minutes 29 seconds West, 396.37 feet to
a point on the southerly right-of-way line of said N. Sycamore Avenue; thence
along said southerly right-of-way line along a curve to the right 120.15 feet,
having a radius of 763.66 feet and a chord bearing of North 61 degrees 16
minutes 04 seconds East; thence continuing along said northerly right-of-way
line North 65 degrees 46 minutes 30 seconds East, 286.25 feet to the point of
beginning. Containing 10.01 acres (435,893 square feet) more or less and being
subject to all public roads, easements, reservations, covenants, and
conditions, if any, now of record.
Section 2. That
upon the effective date of this ordinance, the City Clerk is directed to record
it in the Office of the Clay County Recorder of Deeds in Clay County, Missouri,
as evidence of the acceptance of the land by Kansas City for public use for
park purposes and the Council declares in accordance with the provisions of
Resolution No. 28559, adopted April 28, 2009, by the Board of Parks and
Recreation Commissioners, that the land, in accordance with Section 1004 of the
Charter of Kansas City, shall remain as part of the Parks system forever.
