RESOLUTION NO. 970557

 

Directing the City Manager to undertake appropriate studies and recommend appropriate regulations regarding businesses with video viewing booths/motion picture arcade booths and businesses which have materials for rent or sale as defined by Section 80-156 which constitute less than a substantial or significant portion of the business' stock in trade.

 

WHEREAS, the Council has repeatedly acknowledged the role of the neighborhoods as the foundation of the economic viability of the City; and

 

WHEREAS, the preservation of neighborhoods identifies the essence of basic municipal services and mandates certain reasonable regulations; and

 

WHEREAS, the First Amendment to the United States Constitution embodies protections for those individuals who constitute as groups the neighborhoods to be protected by the City; and

 

WHEREAS, certain conditions on occasion arise when the absolute right of free speech conflicts with rights of individuals or the exercise of free speech creates problems which are threatening or harmful; and

 

WHEREAS, in the face of such circumstances, regulations must be imposed on the exercise of any rights of free speech which are reasonable in time, place, and manner, as narrowly drawn as necessary to overcome the identified problem and provide alternative avenues of communication; and

 

WHEREAS, certain commercial business ventures have developed in the City and such businesses have engaged in certain practices which may have a secondary impact on individuals in the neighborhoods; and

 

WHEREAS, the City desires to pursue reasonable regulations as appropriate to counter and neutralize any secondary impacts created by such business practices; and

 

WHEREAS, it is necessary to undertake appropriate studies to clearly identify the secondary impact of such business practices and the least restrictive manner of regulation to overcome the secondary effects; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

That the City Manager is hereby directed to undertake appropriate studies of certain business practices in Kansas City and to recommend appropriate regulations regarding businesses with video viewing booths/motion picture arcade booths and businesses which have materials for rent or sale as defined by Section 80-156 which constitute less than a substantial or significant portion of the business' stock in trade.
