COMMITTEE SUBSTITUTE FOR
ORDINANCE NO. 000238
Amending
Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0267,
rezoning an area of approximately 3 acres generally located at the southwest
corner of 79th Street and Troost Avenue from District C-2 (Local Retail
Business) to District M-1-p (Light Industry - Limited District), and approving
a preliminary plan for the same. (12398-P)

IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri,
1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a
new section to be known as Section 80-11A0267, rezoning an area of
approximately 3 acres generally located at the southwest corner of 79th Street
and Troost Avenue from District C-2 (Local Retail Business) to District M-1-p
(Light Industry - Limited District), said section to read as follows:
Section
80-11A0267. That an area legally described as:
Lots 25, 26, 27 and 28, Tower Park and Lots 6, 7
8 and 9, Troost Acres and part of the Northeast 1/4 of the Southeast 1/4 of
Section 17, Township 48, Range 33, in Kansas City, Jackson County, Missouri,
described as follows: Beginning in the west line of Troost Avenue at a point 40
feet west of the northeast corner of said Northeast 1/4 of Southeast 1/4 of
Section 17 and running thence west along the north line of said 1/4 1/4
Section, 150 feet; thence south and parallel with the west line of Troost
Avenue, 205 feet; thence east parallel with the first course, a distance of 150
feet to the west line of Troost Avenue; thence north along said street line,
205 feet to the point of beginning.
is
hereby rezoned from District C-2 (Local Retail Business) to District M-1-p
(Light Industry - Limited District), all as shown outlined on a map marked
Section 80-11A0267, which is attached hereto and made a part hereof, and which
is hereby adopted as a part of an amendment to the zoning maps constituting a
part of said chapter and as an amendment to Section 80-11 thereof.
Section
B. That a preliminary plan for the area legally described above is hereby
approved, subject to the following conditions:
1. That
the developer construct or reconstruct curb, gutter, and sidewalks on the south
side of 79th Street and on the north side of 79th Terrace as required by the
Department of Public Works prior to approval of a final plan.
2. That
the developer reconstruct the driveways as shown on the preliminary plan to a
maximum width of 30 feet and provide 15 foot curb radii as required by the
Department of Public Works prior to approval of a final plan.
3. That
the developer submit a final plan to the City Plan Commission for approval,
including detailed information on landscaping, signage (including elevations),
and building elevations.
A
copy of said preliminary plan is on file in the office of the City Clerk under
Document No. 000238, which is attached hereto and made a part hereof.
Section
C. That the Council finds and declares that before taking any action on the
proposed amendment hereinabove, all public notices and hearings required by the
Zoning Ordinance have been given and had.
