ORDINANCE NO. 100945

 

Authorizing the Director of General Services to enter into a five-year lease agreement in the amount of $750.00 monthly with MW Towers, LLC, to allow for the construction and maintenance of a cell tower on City property at 2120 Harrison Street.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of General Services is authorized to execute a five-year lease agreement with the option of five extensions of five-years each with MW Towers, LLC, in the amount of $750.00 monthly for the first five-year term which amount shall increase by thirty percent (30%) per month for each additional carrier located on the tower and shall increase by fifteen percent (15%) per renewal term. A copy of the lease is on file in the General Services Department.

 

Section 2. That the vacant land site is .4081 acres located on the northwest corner of E. 22nd Street and Harrison Street further described in the following legal description:

 

ELM GROVE Addition, Lots 17-21, except south 10 feet of Lot 17 in Row, Block 7.

 

Section 3. That the lease is subject to the following conditions:

a. That the cell provider obtain all temporary construction permits and provide a copy to the General Services Department; and

b. That the cell provider submit construction plans to the General Services Department for approval prior to beginning any construction activities; and

 

c. That proof of insurance coverage for construction activity be presented to the General Services Department.
