RESOLUTION NO. 140888

 

Amending the Heart of the City Area Plan for approximately 4.1 acres generally bounded by E. 27th Street on the north, Prospect Avenue on the east, E. 28th Street on the south, and Wabash Avenue on the west; and lots located at 2716 Wabash Avenue, 2412 E. 28th Street, and 2416 E. 28th Street, to change the recommended land use from Residential Low Density (Urban) to Mixed Use Neighborhood. WHEREAS, an application was submitted by Reverend John Modest Miles, Morningstar’s Development Company, Inc., to amend the Future Land Use Map of the Heart of America Area Plan as it affects 4.1 acres generally bounded by E. 27th Street on the north, Prospect Avenue on the east, E. 28th Street on the south, and Wabash Avenue on the west; and lots located at 2716 Wabash Avenue, 2412 E. 28th Street, and 2416 E. 28th Street, by changing the recommended land use from Residential Low Density (Urban) to Mixed Use Neighborhood in order to permit a proposed MPD rezoning and development plan approval; and

 

WHEREAS, the Council adopted the Heart of the City Area Plan through Resolution No. 110159, as amended, adopted April 21, 2011, and said plan was amended by Resolution No. 140662 adopted on August 21, 2014, which Plan established guidelines and standards for future development and redevelopment of the plan area; and

 

WHEREAS, because of planning and other considerations, it has become necessary and desirable to make certain modifications to the land uses, guidelines and standards set forth in the Heart of America Area Plan, specifically relating to approximately 4.1 acres generally bounded by E. 27th Street on the north, Prospect Avenue on the east, E. 28th Street on the south, and Wabash Avenue on the west; and lots located at 2716 Wabash Avenue, 2412 E. 28th Street, and 2416 E. 28th Street, to recommend Mixed Use Neighborhood rather than Residential Low Density (Urban); and

 

WHEREAS, legal notice of the public hearing before the City Plan Commission was published in conformity with state and local laws; and

 

WHEREAS, the City Plan Commission considered such amendment to the Proposed Land Use Plan and Map on September 16, 2014; and

 

WHEREAS, after all interested persons were given an opportunity to present testimony, the City Plan Commission did on September 16, 2014, recommend approval of the proposed amendment to the Heart of the City Area Plan; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the Heart of the City Area Plan is hereby amended for about 4.1 acres generally bounded by E. 27th Street on the north, Prospect Avenue on the east, E. 28th Street on the south, and Wabash Avenue on the west; and lots located at 2716 Wabash Avenue, 2412 E. 28th Street, and 2416 E. 28th Street, by changing the recommended land use from Residential Low Density (Urban) to Mixed Use Neighborhood.

 

Section B. That this amendment to the Heart of the City Area Plan is consistent and complies with the FOCUS Kansas City Plan, adopted on October 30, 1997, by Committee Substitute for Resolution No. 971268, and is adopted as a supplement to the FOCUS Kansas City Plan.

 

Section C. That the Council finds and declares that before taking any action on the proposed area plan amendment hereinabove, all public notices have been given and hearings have been held as required by law.
