ORDINANCE NO. 190692

 

Authorizing the Director of the Parks and Recreation Department to purchase a new Parks North Maintenance District Building located at 3515 N.E. 33rd Terrace and 3516 N.E. 33rd Terrace, Kansas City, Missouri in the amount of $3,650,000.00; authorizing the financing of a portion of the purchase price in an amount not to exceed $2,450,000.00; estimating revenue and appropriating $1,500,000.00 in Fund 2030, Parks and Recreation Fund; estimating revenue and appropriating $2,460,000.00 in Fund 3440, the Special Obligation Series 2020B Fund; designating requisitioning authorities; authorizing the Director of Finance to close project accounts upon completion; and declaring the intent of the City to reimburse itself from the bond proceeds for certain expenditures.

 

WHEREAS, the Parks and Recreation Department currently houses its north maintenance district and park facility maintenance divisions at the PACCAR building located at 4701 Deramus and 1301 Chouteau Trafficway and this facility is shared with the refuse abatement trucks and mowing equipment of Neighborhoods and Housing Services along with a steel manufacturing company; and

 

WHEREAS, Parks and Recreation desires to relocate employees with the purchase of a building located at 3515 N.E. 33rd Terrace and 3516 N.E. 33rd Terrace because the proposed location has easy access to major roadways; and

 

WHEREAS, additionally, the purchase will allow a significant increase in space to store specialized equipment and fleet inventory, which is anticipated to extend the inventory’s life; and

 

WHEREAS, the purchase price is $3,650,000.00 with an additional $300,000.00 investment needed in facility improvements; and

 

WHEREAS, pursuant to Resolution No. 31290, the Board of Parks and Recreation Commissioners has approved the purchase and financing with $1,500,000.00 to be paid from donations to Kansas City Parks and Recreation and the balance of $2,450,000.00 financed with debt payments paid from the Parks Sales Tax; and

 

WHEREAS, the payment of scheduled debt service payments on the 2020 Special Obligation Bonds will be made by annual appropriation of monies from the City’s General Municipal Revenues over a successive twenty (20) year period; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of the Parks and Recreation Department is hereby authorized to execute a purchase agreement with Orizon Aerostructures LLC, in the amount of Three Million Six Hundred and Fifty Thousand Dollars and No/100 ($3,650,000.00) for the purchase of a building located at located at 3515 N. E. 33rd Terrace and 35116 N.E. 33rd Terrace to be used a new Parks North Maintenance District Building. A copy of the agreement in substantial form is on file in the Office of the Director of Parks and Recreation.

 

Section 2. That the Director of the Parks and Recreation Department is hereby authorized to execute any real estate or other documents needed to effectuate the transactions noted herein for the property commonly known as 3515 N.E. 33rd Terrace and 3516 N.E. 33rd Terrace, Kansas City, Missouri, and legally described as:

 

Tract I: All of Lots 3 and 4, Chouteau Industrial Park Resurvey, a subdivision in the City of Kansas City, Clay County, Missouri, according to the recorded plat thereof.

 

Tract II: All of Lot 3, Cerner Campus, Third Plat, a subdivision in the City of Kansas City, Clay County, Missouri, according to the recorded plat thereof.

 

Tract III: All of Lot 2, Chouteau Industrial Park Resurvey, a subdivision in Kansas City, Clay County, Missouri, except that part deeded to the City of Kansas City, Missouri, in Document No. 2011009796, recorded March 29th, 2011, in Book 6598, at Page 150.

 

Such Tracts 1, 2 and 3 are collectively referred to the proposed Site.

 

Section 3. That the revenue in the following account of the Special Obligation Series 2020B Fund is hereby estimated in the following amount:

 

AL-3440-120000-590000 Bond Proceeds $2,460,000.00

 

Section 4. That the sum of $2,460,000.00 is hereby appropriated from the Unappropriated Fund Balance of the Special Obligation Series 2020B Fund to the following accounts:

 

AL-3440-708027-E-70204962 Parks-Buildings $2,450,000.00

AL-3440-129620-B Costs of Issuance 10,000.00

TOTAL $2,460,000.00

 

Section 5. That the revenue in the following account of the Parks and Recreation Fund is hereby estimated in the following amount:

 

20-2030-700000-482930 Contrib-Special Gifts Fund $1,500,000.00

 

Section 6. That the sum of $1,500,000.00 is hereby appropriated from the Unappropriated Fund Balance of the Parks and Recreation Fund to the following account:

 

20-2030-708027-E-70204962 Parks – Buildings $1,500,000.00

 

Section 7. That the Director of Parks and Recreation Department is hereby designated as requisitioning authority for Account Nos. AL-3440-708027 and 20-2030-708027 and that the Director of Finance is hereby designated as requisitioning authority for Account No. AL-3440- 129620.

 

Section 8. That the Director of Finance is hereby authorized to close project accounts, encumbrances and retainage related to the accounts in Section 4 and Section 6, and return the unspent portion to the fund balance from which it came upon the earliest of: (i) Project’s completion; (ii) final maturity of financing, or (iii) five years after issuance.

 

Section 9. That the City hereby declares its official intent to reimburse itself for certain expenditures made within sixty (60) days prior to or on and after the date of this ordinance with respect to the Project with the proceeds of the bonds to be issued. The maximum principal of amount of bonds intended to be issued for the Project expected is $2,460,000.00. This constitutes a declaration of official intent under Treasury Regulation Section 1.150-2.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
