ORDINANCE NO. 140889

 

Rezoning approximately 4.1 acres generally bounded by E. 27th Street on the north, Prospect Avenue on the east, E. 28th Street on the south, and Wabash Avenue on the west; and lots located at 2716 Wabash Avenue, 2412 E. 28th Street, and 2416 E. 28th Street from Districts B3-2 and R1.5 to District MPD, and approving an MPD plan for a community center, adult daycare center, and worship center and residential uses. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning and Development Code, is hereby amended by enacting a new section to be known as Section 88-20A0981, rezoning an area of approximately 4.1 acres generally bounded by E. 27th Street on the north, Prospect Avenue on the east, E. 28th Street on the south, and Wabash Avenue on the west; and lots located at 2716 Wabash Avenue, 2412 E. 28th Street, and 2416 E. 28th Street from Districts B3-2 (Community Business) and R1.5 (Residential, 1,500 sq. ft. lot area) to District MPD (Master Planned Development), said section to read as follows:

 

Section 88-20A0981. That an area legally described as:

 

Smith's Prospect Avenue---Lots 10 thru 18 & Avondale, Lots 16 thru 18,

together with, Smith's Prospect Avenue---Lots 1 thru 9 & Avondale, Lots 1 thru 3

 

Also described as: A tract of land being generally located in the City of Kansas City, Jackson County, Missouri, being described as follows: Beginning at the point of intersection of the centerlines of Prospect Avenue and 27th Street, thence southerly along said centerline of Prospect Avenue to the intersection of the centerline of 28th Street, thence westerly along the centerline of 28th Street to the intersection of the centerline of Wabash Avenue, thence northerly along the centerline of Wabash Avenue to the intersection of the centerline of 27th Street, thence easterly along the centerline of 27th Street to the point of beginning, except that part in 27th Street, Prospect Avenue, 28th Street, Wabash Avenue, and alley right-of-way.

 

is hereby rezoned from Districts B3-2 and R1.5 to District MPD, all as shown outlined on a map marked Section 88-20A0981, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and in accordance with Section 88-20 thereof.

 

Section B. That a development plan for a community center, adult daycare center, and worship center and residential uses, is hereby approved, subject to the following conditions:

 

1)                  That the developer submit a final MPD development plan (88-520-04) prior to a request for a building permit, for review by the Development Review Committee. As determined during preliminary plan review, the final plan shall include planting materials (other than sod) between the sidewalk and the retaining wall along Prospect Avenue.

 

2)                  That the developer cause the area to be platted and processed in accordance with Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, as amended.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning and Development Code have been given and had.
